Common use of No Project Liability Clause in Contracts

No Project Liability. Notwithstanding any provisions in this Agreement to the contrary, if the Project involves construction, as that term is generally understood, and Xxxxxxxxx does not provide Services during construction, including, but not limited, to, observation, site visits, shop drawing review, and design clarifications, Client agrees to defend, indemnify and hold harmless Xxxxxxxxx, its agents, officers, directors, employees, contractors and consultants from any and all liability (including reasonable attorneys’ fees and court costs) arising out of the Project or this Agreement.
