Common use of No Ratification of Unlicensed Use Clause in Contracts

No Ratification of Unlicensed Use. No act or failure to act by District with regard to any unlicensed use shall be deemed as ratification of the unlicensed use and if any Permit should be subsequently issued, such Permit shall not operate retroactively or constitute a waiver by District of any of its rights or privileges under this Agreement or otherwise; provided, however, that Licensee shall be subject to all liabilities, obligations and responsibilities of this Agreement in regards to the unauthorized use from its inception.

No act or failure to act by the District with regard to any unlicensed use shall be deemed as ratification of the unlicensed use and if any Permit should be subsequently issued, such Permit shall not operate retroactively or constitute a waiver by the District of any of its rights or privileges under this Agreement or otherwise; provided, however, that Licensee shall be subject to all liabilities, obligations and responsibilities of this Agreement and the Applicable Standards in regards to the unauthorized use from its inception.

No act or failure to act by District Owner Utility with regard to any said unlicensed use shall be deemed as ratification of the unlicensed use and if any Permit should be subsequently issued, such Permit shall not operate retroactively or constitute a waiver by District Owner Utility of any of its rights or privileges under this Agreement or otherwise; provided, however, that Licensee Attaching Utility shall be subject to all liabilities, obligations and responsibilities of this Agreement in regards to the unauthorized said unauthorised use from its inception.

No act or failure to act by District Grant PUD with regard to any unlicensed use shall be deemed as ratification of the unlicensed use and if any Permit should be subsequently issued, such Permit shall not operate retroactively or constitute a waiver by District Grant PUD of any of its rights or privileges under this Agreement or otherwise; provided, however, that Licensee shall be subject to all liabilities, obligations and responsibilities of this Agreement in regards to the unauthorized use from its inception.

Any Permit should be subsequently issued, such Permit issued for a previously unauthorized Attachment shall not operate retroactively or constitute a waiver by District Utility of any of its rights or privileges under this Agreement or otherwise; provided, however, that and Licensee shall be remain subject to all liabilities, obligations and responsibilities arising out of this Agreement in regards or related to the its unauthorized use from its inception.

No act or failure to act by District Town with regard to any unlicensed use or use without a Permit shall be deemed as ratification of the unlicensed use use, and if any Permit should be subsequently issued, such Permit shall not operate retroactively or constitute a waiver by District Town of any of its rights or privileges under this Agreement or otherwise; provided, however, that Licensee shall be subject to all liabilities, obligations obligations, and responsibilities of this Agreement in regards regard to the unauthorized use from its inception.
