No Separate Entity. This agreement does not create any separate legal or administrative entity for the purpose of implementing or administering the terms and conditions of this agreement.
No Separate Entity. No separate legal or administrative entity shall be created for the governance or administration of the terms or subject matter of this Agreement.
No Separate Entity. The Parties are not forming a separate entity as part of this Agreement. This Agreement shall not be deemed or construed to create a separate legal entity or to create a joint venture or partnership among the Parties. Each Party represents and warrants that it has the authority to enter into this Agreement.
No Separate Entity. It is not the intention that a separate legal entity be established to conduct this cooperative undertaking, and no separate legal entity is established by this Agreement.
No Separate Entity. This MOU does not create an agency or entity that is separate from the parties to the agreement.
No Separate Entity. This Agreement does not create a separate legal or administrative entity and no third party rights are created by the enactment of this Agreement. As allowed in §00-00-000 of the Utah Code, both Parties are cooperating jointly together to exercise their individual powers and privileges.
No Separate Entity. This MOA does not create a legal entity under the Joint Exercise of Powers Act (Government Code sections 6500 and following) or any other law, which would authorize the execution of contracts, provide the right to xxx or be sued, or otherwise create a separate legal entity under the laws of California. Instead, this MOA establishes a mutual understanding to collectively carry out the MOA Activities in furtherance of the Project, which the Parties believe could provide a variety of benefits to communities that they serve and the region by increasing water storage and supplies, improving the operation of the state’s water system, and improving ecosystem and water quality conditions in the San Xxxxxxx Valley and the Sacramento- San Xxxxxxx Delta.
No Separate Entity. It is not contemplated that, as a result of this Agreement, any property, real or personal, will be jointly acquired by the parties to this Agreement. This Agreement does not establish or create a separate fund or legal entity. Neither party is authorized to bind the other to any contract or obligation. Each party to this Agreement shall be responsible for its own budgeting.
No Separate Entity. It is the intent of the Participants that this Memorandum of Understanding does not create a separate legal entity to provide for its administration. It shall be administered by the Executive of each of the Participants. Participants shall not jointly acquire, hold or dispose of real or personal property pursuant this Memorandum, except as specifically set forth herein.
