An Agency. Department Head may authorize that a particular position be filled at any rate within the salary range, up to the top of the advertised maximum rate of the range. In determining the salary offer, the Agency/Department Head shall consider the following: 1. The market demands a greater salary offer; 2. The candidate’s previous education, training, experience and employment references enable the candidate to make an immediate greater contribution to the County; 3. The offer does not negatively impact the department’s budget or internal salary relationships within the Department or Countywide.
An Agency. (1) Consistent with paragraph (a) of this section, is not required to include the award term in Appendix A to this part if it determines that there is no possibility that the total amount of Federal funding under the award will equal or exceed $25,000. However, the agency must subsequently amend the award to add the award term if changes in circumstances increase the total Federal funding under the award to $25,000 or more during the project or program period.

An AgencyDepartment Head shall have fifteen working days after receipt of the written appeal in which to review, hold hearings, and answer the grievance in writing. Unless waived by the mutual agreement of the employee or his/her representative and the Agency/Department Head, a hearing is required at this step and the employee and his/her representative shall have the right to be present at and participate in any such hearing. The time limit at this step may be extended by mutual agreement between the Agency/Department Head and the employee or his/her representative. The Union may, in its own name, file a grievance alleging that the County has failed to provide it some organizational right which is established by a resolution or ordinance of the Board of Supervisors, by written agency/department rules, state law or by this Memorandum of Understanding as adopted by ordinance, provided that the enjoyment of such right is not made subject to the discretion of the Agency/ Department Head or the County. Such Union grievances shall be filed with the Agency/Department Head and heard and determined pursuant to the provisions of the fourth step of the grievance procedure.
An Agency employee who applies for a transfer or promotion will be interviewed if the employee has passed the qualifying test for the vacant position and is active on the appropriate qualifying list.

  • OTHER AGENCIES Other tax supported agencies within the State of California who have not contracted for their own requirements may desire to participate in this contract. The Contractor is requested to service these agencies and will be given the opportunity to accept or reject the additional requirements. If the Contractor elects to supply other agencies, orders will be placed directly by the agency and payments made directly by the agency.
