NON-SMOKING POLICY. All employees hired after June 1, 1988, shall be required to sign a "Statement of Acceptance" evidencing an agreement to refrain from smoking tobacco at any time upon attaining the classification of Deputy Sheriff or a higher paid classification. Any such employee who does not honor that agreement shall be subject to disciplinary action up to and including termination. Sec. 707 COUNTY'S RIGHT TO MAKE CHANGES: Except as otherwise provided in Section 701, the parties agree that the County retains the exclusive right to make changes in accordance with law and good professional practice necessary to administer the Flexible Benefits Programs, and VCDSA specifically waives any rights it may have to meet and confer with respect to the decision or impact of changes. Notwithstanding the above, the County shall not eliminate or make changes to the VCDSA health care portion of its Flexible Benefits Program as long as that plan’s provisions are consistent with applicable State and Federal laws.
