Effect of Breach and Right to Terminate Lease. A breach of this Lease Addendum shall give each party all the rights contained herein, as well as the rights in the Lease. A material breach of this Addendum shall be a material breach of the lease and grounds for immediate termination of the Lease by the Landlord.
Effect of Breach and Right to Terminate Lease. Lessee’s are responsible for the actions of their household, their guests and visitors. Failure to adhere to any of the conditions of this Addendum will result in a $500 violation fee. In addition, the Lessee(s) will be responsible for all costs to remove smoke odor or residue upon any violation of this Addendum. Furthermore, Lessor shall have the right, at its sole discretion, to immediately terminate the Lease.

Due to the extreme hazard to life and property created by smoking in the presence of medical oxygen, any substantiated report of a tenant or guest smoking in a unit in which medical oxygen is in use shall result in the Management taking immediate action to evict the tenant in accordance with the terms of his or her lease.

Property Manager/Owner acknowledges that in declaring the building (or portion of the building and outdoor areas) to be smoke-free, the failure to respond by Property Manager/Owner to a complaint filed by the Resident shall be treated as equivalent to failure to respond to request for maintenance. Tenant agrees that Landlord may assess the following non-rent charges to Tenant for each violation of the No Smoking Policy reported by Landlord, neighbors or law enforcement officers. These charges shall include all violations caused by persons residing in the premise, as well as Tenant’s guests and/or invitees. 1st Smoking Violation – Written Warning; 2nd Smoking Violation – $100.00 fine; 3rd Smoking Violation – $200.00 fine and 5-day notice of eviction for continued noncompliance, which may result in an eviction action. Tenant acknowledges that the remedy for smoking within the apartment may be the assessment of a charge of up to two hundred-fifty dollars ($250.00) for each smoking incident. Charges will be used by the BHA towards the costs of refurbishing the apartment.

A material breach of the Smoke‐Free Housing Policy shall be considered a material breach of the Lease Agreement and grounds for immediate termination of the Lease by GDPM. By signing these House Rules, Resident acknowledges that GDPM may terminate the lease agreement if the Resident, a member of Resident’s household, or any guest under Resident’s control in any way violates or breaches the Smoke‐Free Housing Policy.
