Common use of Not to excavate Clause in Contracts

Not to excavate. The Lessee shall not make any excavation upon of the Leased Land or any part thereof nor remove any stone sand, gravel, clay or earth there from except for the purpose of forming foundations of building or for the purpose of executing any work pursuant to the terms of this Agreement.
