Common use of Notice of Proposed Action Clause in Contracts

Notice of Proposed Action. Before taking severe disciplinary action, the Sheriff or his/her designee shall serve on the employee, either personally or by certified mail, a Notice of Proposed Action, which shall contain the following: (1) A statement of the action proposed to be taken. (2) A copy of the charges, including the acts or omissions and grounds upon which the action is based. (3) If it is claimed that the employee has violated a rule or regulation of the County or Department, a copy the rule(s) shall be included with the notice. (4) A statement that the employee may review and request copies of materials upon which the proposed action is based prior to the response meeting. (5) A statement that the employee has five (5) working days to respond to the Sheriff or his/her designee either orally or in writing. If the employee chooses to reply orally, the employee is entitled to a meeting with the Sheriff or his/her designee.
