Notice to State. The MCO must notify the STATE of a possible Material Modification in its Provider Network within ten (10) working days from the date the MCO has been notified that a Material Modification is likely to occur. A Material Modification shall be reported in writing to the STATE no less than one hundred and twenty (120) days prior to the effective date or within two (2) working days of becoming aware of it, whichever occurs first. An MCO may terminate a subcontract without one hundred and twenty (120) days’ notice in situations where the termination is for cause. For purposes of this section, termination of a Provider for cause does not include the inability to reach agreement on contract terms.

18.1. Waiver by either Party of the other's non-performance or violations of any term or condition of this Agreement shall not constitute a waiver of any other non performance or violation of any other term or conditions of this Agreement, or of the same non-performance or violation in the future.
19.1. Employees shall be entitled to all the rights and benefits provided by this Agreement.

Notice to State. 17. By providing a copy of this Agreement to MDNR, EPA and GSA are notifying the State of Missouri of this Agreement.
Notice to State. Contractor shall notify State as soon as it is aware of a Data Incident, and in all cases no later than 24 hours after Contractor has knowledge of a Data Incident. The Data Incident should be communicated to the State’s Contract Manager.
Notice to State. If Provider terminates this agreement, County shall send a copy of the notice of termination to the State of California Department of Health Services.
Notice to State. In the event of damage to or destruction of Lease Area or Improvements located within Lease Area, Lessee shall give written notice to State within fourteen (14) business days. State does not have actual knowledge of the damage or destruction without Lessee’s written notice.
