Nutzung der Apple-Software. Als Voraussetzung für die Nutzung der Apple-Software erklären Sie sich mit Folgendem einverstanden: (a) Sie werden die Apple-Software nur für die Zwecke dieses Vertrags und in der durch diesen Vertrag ausdrücklich gestatteten Xxxxx und in Übereinstimmung mit xxxxx anwendbaren Gesetzen und sonstigen Rechtsvorschriften nutzen; (b) Sie werden die Apple-Software weder für rechtswidrige oder illegale Aktivitäten nutzen, noch erfasste Produkte jeglicher Art entwickeln, die die Begehung einer Straftat oder einer anderen unerlaubten, rechtswidrigen oder ungesetzlichen Handlung begründen oder vereinfachen; (c) Ihr Softwareprogramm, Ihre Bibliothek und/oder Ihr Pass wird in Übereinstimmung mit der Dokumentation und den Programmvoraussetzungen entwickelt, die in ihrer derzeitigen Form in Absatz 3.3 festgelegt sind, und Sie werden die Entwicklung eines Softwareprogramms, einer Bibliothek oder Passes, das/der diese Bestimmungen verletzt, nicht unterstützen, fördern oder anderweitig ermöglichen; (d) Nach bestem Wissen und Gewissen verstoßen Ihre erfassten Produkte nicht gegen Urheberrechte, Xxxxxx, private und öffentliche Rechte, Geschäftsgeheimnisse, Patente oder andere Eigentumsrechte oder gesetzmäßige Rechte (z. B. Rechte an Musikkompositionen oder Auftritten, Videorechte, Foto- oder Bildrechte, Logorechte, Rechte an den Daten Dritter usw. für Inhalte und Materialien, die möglicherweise in Ihrem Softwareprogramm enthalten sind) von Apple oder Dritten noch wird es diese widerrechtlich verwenden, gegen diese Rechte verstoßen oder dies in Zukunft tun; (e) Sie verpflichten sich, es zu unterlassen, durch die Nutzung der Apple-Software, von Apple ausgestellten Zertifikaten, Diensten oder auf andere Xxxxx erfasste Produkte oder anderen Code oder andere Programme zu erstellen, die Sicherheitsvorkehrungen, digitale Signaturen, Verwaltung digitaler Rechte, Prüf- oder Identifizierungsmechanismen, die in iOS, der Apple- Software oder sonstiger Apple-Software oder -Technologie implementiert sind oder durch diese implementiert werden, außer Kraft setzen, zerstören oder auf andere Xxxxx beeinträchtigen, oder Dritten zu gestatten, dies zu tun; (f) Softwareprogramme, die mithilfe der Apple-Software entwickelt wurden, dürfen nur für die eingeschränkte Verteilung auf autorisierten Geräten verteilt werden, wie in diesem Vertrag vorgesehen.   • Antivirus software All workstations, laptops and other systems that process and/or store PHI COUNTY discloses to CONTRACTOR or CONTRACTOR creates, receives, maintains, or transmits on behalf of COUNTY must have installed and actively use comprehensive anti-virus software solution with automatic updates scheduled at least daily.

  • Open Source Software The Software product may include certain open source components that are subject to open source licenses (“Open Source Software”), in which case, the embedded Open Source Software is owned by a third party. The Open Source Software is not subject to the terms and conditions of this XXXX. Instead, each item of Open Source Software is licensed under its applicable license terms which accompanies such Open Source Software. Nothing in this XXXX limits your rights under, nor grants you rights that supersede, the terms and conditions of any applicable license terms for the Open Source Software. Any fees charged by GC in connection with the SOFTWARE, do not apply to the Open Source Software for which fees may not be charged under the applicable license terms. The terms and conditions of the applicable license for the Open Source Software are available on the LICENSE.txt file, which is provided with the SOFTWARE.

  • Embedded Software To the extent any goods contain Embedded Software (defined below) that is not Buyer’s Property, no title to such Embedded Software shall pass to Buyer, and Supplier shall grant Buyer, its customers and all other users a non-exclusive worldwide, irrevocable, perpetual, royalty-free right to use, load, install, execute, demonstrate, market, test, resell, sublicense and distribute such Embedded Software as an integral part of such goods or for servicing the goods (the “Buyer-Required License”). If such Embedded Software or any part thereof is owned by a third party, prior to delivery, Supplier shall obtain the Buyer-Required License from such third-party owner. “Embedded Software” means software necessary for operation of goods and embedded in and delivered as an integral part of goods.

  • Additional Software Should any additional Software licenses be purchased during the Term: (a) In the case of Permanent Licenses, the maintenance Fees will be pro-rated till the Expiry Date and these licenses will be added to the Supported Software. (b) In the case of Subscription Licenses, the license Fees will be pro-rated till the Expiry Date and these licenses will be added to the Supported Software. (c) In the case of Monthly Licenses, the licenses will be subject to their own support and maintenance agreement. (d) The Customer may request that support of certain bundles of licenses be subject to their separate support and maintenance agreements, in which case the expiry dates of these agreements may not coincide.

  • Software Warranty We warrant that the Tyler Software will perform without Defects during the term of this Agreement. If the Tyler Software does not perform as warranted, we will use all reasonable efforts, consistent with industry standards, to cure the Defect in accordance with the maintenance and support process set forth in Section C(9), below, the SLA and our then current Support Call Process.

  • Server Software Subject to the terms and conditions of this XXXX, Vocera grants you the non-exclusive right to (i) install and run (“Use”) the Server Software on computer systems (each, a “Server Computer”) located at End User’s Facilities in the geographic territory designated above (“Territory”); (ii) to Use the Client Software in conjunction with Authorized Client Devices and such Server Computers; and (iii) for pilot licenses for certain Software provided on a trial basis, use such Software for the limited term specified by Vocera in writing. You may Use the standard Server Software on one primary Server Computer (or a primary cluster of computers suitably configured for productive use of the Server Software). You may install backup copies of the Server Software on backup Server Computers to provide redundancy in the event of failure of the primary Server Computer(s) but, unless you have acquired additional licenses or a failover license from Vocera, you may not run such backup or additional copies concurrently with the primary copies. Vocera grants you the right to use the applicable License Key issued by Vocera only to enable Use of the Server Software in conjunction with the licensed Server Computers. Server Software may be licensed for a Subscription Term as specified in the Quote.

  • Limited Software Warranty MyECheck represents, warrants, and covenants that: MyECheck warrants to the original end user (“Customer”), and not to subsequent end users, of the Extreme Networks software product (“Software”) that for ninety (90) days from the date of installation of the Software from MyECheck, the Software shall substantially conform with the specification for the Software at the (“Documentation”). MyECheck does not warrant (i) that the Software is error free, (ii) that Customer will be able to operate the Software without problems or interruptions or (iii) that the Software will be free of vulnerability to intrusion or attack. Except for the limited warranty set forth in this section, the Software is provided “AS IS.”

  • Evaluation Software If the Software is an evaluation version or is provided to You for evaluation purposes, then, unless otherwise approved in writing by an authorized representative of Licensor, Your license to use the Software is limited solely for internal evaluation purposes in non-production use and in accordance with the terms of the evaluation offering under which You received the Software, and expires 90 days from installation (or such other period as may be indicated within the Software). Upon expiration of the evaluation period, You must discontinue use of the Software, return to an original state any actions performed by the Software, and delete the Software entirely from Your system and You may not download the Software again unless approved in writing by an authorized representative of Licensor. The Software may contain an automatic disabling mechanism that prevents its use after a certain period of time. RESTRICTIONS

  • Hardware Warranty Company warrants that for a period of one (1) year from delivery of Hardware, Hardware will be free from defects in material and workmanship in normal use, but does not cover any of the following: (i) improper installation, maintenance, adjustment, repair or modification by Customer or a third party; (ii) misuse, neglect, or any other cause other than ordinary use, including without limitation, accidents or acts of God; (iii) improper environment, excessive or inadequate heating or air conditioning, electrical power failures, surges, water damage or other irregularities; (iv) third party software or software drivers; or (v) damage during shipment.

  • Unbundled Copper Loop – Designed (UCL-D) 2.4.2.1 The UCL-D will be provisioned as a dry copper twisted pair (2- or 4-wire) Loop that is unencumbered by any intervening equipment (e.g., filters, load coils, range extenders, digital loop carrier, or repeaters). 2.4.2.2 A UCL-D will be 18,000 feet or less in length and is provisioned according to Resistance Design parameters, may have up to 6,000 feet of bridged tap and will have up to 1300 Ohms of resistance. 2.4.2.3 The UCL-D is a designed circuit, is provisioned with a test point, and comes standard with a DLR. OC is a chargeable option for a UCL-D; however, OC is always required on UCLs where a reuse of existing facilities has been requested by Telepak Networks. 2.4.2.4 These Loops are not intended to support any particular services and may be utilized by Telepak Networks to provide a wide-range of telecommunications services as long as those services do not adversely affect BellSouth’s network. This facility will include a Network Interface Device (NID) at the customer’s location for the purpose of connecting the Loop to the customer’s inside wire. 2.4.2.5 Upon the Effective Date of this Agreement, Unbundled Copper Loop – Long (UCL-L) elements will no longer be offered by BellSouth and no new orders for UCL-L will be accepted. Any existing UCL-Ls that were provisioned prior to the Effective Date of this Agreement will be grandfathered at the rates set forth in the Parties’ interconnection agreement that was in effect immediately prior to the Effective Date of this Agreement. Existing UCL-Ls that were provisioned prior to the Effective Date of this Agreement may remain connected, maintained and repaired according to BellSouth’s TR73600 and may remain connected until such time as they are disconnected by Telepak Networks or BellSouth provides ninety
