Obligation to Grade According to Lot Grading Plan. The Lands shall not be graded except in general conformity with the grades and elevations shown on the approved Lot Grading Plan. The Lot Grading Plan shall bear the signature and seal of an Ontario Professional Engineer holding a Certificate of Authorization from Professional Engineers Ontario or who is employed by a partnership or corporation holding such Certificate of Authorization to offer professional engineering services to the public (hereinafter called a “Professional Engineer”) or a Registered Ontario Land Surveyor who certifies thereon that the Plan generally conforms with the Lot Grading Plan attached to the Agreement or filed with the Director of Infrastructure and Development.
