Common use of OCCASIONAL TEACHERS’ LIST(S) Clause in Contracts

OCCASIONAL TEACHERS’ LIST(S). 9.01 An Occasional Teacher must be a member in good standing of the Ontario College of Teachers in order to be placed on the Occasional Teachers' List. 7 9.02 Only Teachers on the Occasional Teachers' List shall receive calls for short-term occasional teaching assignments except where the Board is required to appoint a person in the event of an emergency. 9.03 The Occasional Teacher list shall be limited to thirty-four percent (34 %) of the Board's FTE allotment of teachers, such percent to include those teachers assigned to the Occasional Teacher Priority-Calling List for teaching the Developmentally Delayed. Where the list is not sufficient to meet the board's specific program needs to supply Occasional Teachers to the system the Board may, after consultation with the Bargaining Unit, increase the number of names on the list, to maintain a sufficient pool of names. This increased number shall not exceed two percent (2%) of the limit specified above. 9.04 Where the list is not sufficient to meet the Board's needs to supply Occasional Teachers to the system the Board may, after consultation with the Bargaining Unit, increase the number of names on the list, to maintain a sufficient pool of names. 9.05 There shall be no additions made to the Occasional Teachers' List without prior consultation with the members of the Secondary Occasional Teachers Labour/Management Committee. 9.06 The Occasional Teachers' List shall provide the following information for each Occasional Teacher: full name, telephone number, mailing address, and subjects that the Occasional Teacher is qualified to teach. Occasional Teachers shall be listed in alphabetical order. 9.07 Occasional Teachers shall notify the Human Resources Department of the Board, in writing, of any changes of qualifications or address and/or telephone number required by the Board to contact the Occasional Teacher regarding teaching assignments. 9.08 The Board shall send an up-to-date Occasional Teachers' List to the Bargaining Unit by October 31 and February 28 in each school year. Any sub-lists for individual schools shall be included in this package. 9.09 The Board will forward a revised Occasional Teachers' List, including amendments, to both the Bargaining Unit and to the appropriate staff at the secondary schools within the Board, on a monthly basis. Any revisions to sub- lists for individual schools shall be included in this package. 9.10 The Board shall send an up-to-date list of those Teachers from the Occasional Teachers' list employed on Long-Term assignments to the Bargaining Unit by the 30th of each month. 9.11 Upon request, and with reasonable notice, up to four times a year, and at no cost to the Bargaining Unit, the Board will provide the Bargaining Unit with a set of mailing labels of those teachers on the Occasional Teacher's List. The Bargaining Unit may purchase additional labels at cost. 9.12 Where an Occasional Teacher requests, in writing, that their name be removed from the List, the Board will remove it from the next published list. 9.13 The Bargaining Unit President shall be provided with a list, at the end of each month, identifying the location and the dates that an unqualified person was hired to teach in the case of an emergency.

The Bargaining Unit Union shall be notified of any amendments. The occasional teacher, the bargaining unit and ETFO, as the case may purchase additional labels at costbe shall indemnify and save the Board harmless from any and all complaints, claims, suits, attachments and any form of liability associated with release of such information to the union. 9.12 Where an Occasional Teacher requests13.9 An occasional teacher’s name shall be removed from the list(s) for the following reasons: i) the occasional teacher asks, in writing, that to have their name be removed from the Listlist(s); ii) the occasional teacher continually refuses assignments or is continually not available or cannot be reached because the contact information has not been updated by the teacher; iii) the occasional teacher fails to submit notice, in writing, on the appropriate form by May 31st, of their intent to be available for the following school year; iv) the occasional teacher is removed for Just Cause. 13.10 Any occasional teacher removed from the list for i), ii), iii), iv), v), above will be informed in writing, and the Union President, within ten (10) school days. 13.11 With the approval of the appropriate Superintendent an occasional teacher may be granted a leave of absence from the Algoma District School Board list(s) to accept a Long-term Occasional assignment with another Board. 13.12 By October 31st, of each school year, upon the request of the Union, the Board will remove it shall provide the Algoma Occasional Teacher Local a report of the number of contract positions filled by Algoma Occasional Teacher members from September 1 to August 31st of the next published listprevious school year. 9.13 The Bargaining Unit President shall be provided with a list, at the end of each month, identifying the location and the dates that an unqualified person was hired to teach in the case of an emergency.
