OPERATOR'S ROLE. The Shipper shall appoint the Operator as its agent for the purposes of: • Keeping its Shared Stock Level up to date; • Calculating the Guarantee and the indemnities for negative stock and offsetting; • Calculating the quantities of gas or the amounts that the Shipper Responsible owes to the Affected Shippers in accordance with the provisions of this Appendix, and communicate this information to the Shippers concerned; • Retaining the security deposit and ensuring the validity of the guarantees set up pursuant to this Appendix; • Implementing these guarantees or sending injunctions to pay in the cases provided for in this Appendix and indemnifying the Affected Shippers under the conditions provided for in this Appendix. This mandate is a mutual-interest mandate and cannot be revoked by the Shipper without the agreement of the Operator. It is expressly agreed that the Operator shall not be liable for the successful completion of offsetting in kind or financial offsetting of the quantities lacking. Under no circumstances shall the Operator be required to procure or sell gas, use transportation or storage services or personally pay any money to the Shipper under this Appendix. Within the scope of this Appendix, the Operator's liability shall in any case be limited to the amounts shown in the General Terms and Conditions in Appendix 2. The Shipper shall waive, and shall vouch for the waiver of by its insurers, the right to any recourse against the Operator if payments have been made by the latter in accordance with the provisions of this Appendix. The Shipper shall reimburse the Operator, in proportion to its annual subscription, all the expenses that the latter will incur at the time of the services carried out pursuant to this Appendix. By way of exception to the provisions of Article 25 of the General Terms and Conditions, the Shipper shall expressly authorise the Operator to disclose to the other Shippers the information provided under Article 3.4 below, which enables the implementation of this Appendix.

OPERATOR'S ROLE. The User acknowledges that the Operator will maintain the Network for the Company under the SABRENet Operation and Maintenance Deed, and that upon the termination or expiry of that deed the Company will subcontract the maintenance of the Network to an appropriate alternative service provider.

  • Operators Any and all Operators of the Equipment shall be duly experienced, trained and qualified to operate Equipment of this type. Although We may, from time to time, recommend certain qualified Operators with whom We are familiar, We do not supply Operators. You must supply and employ any Operator who operates the Equipment (even if the Operator is the owner of the Equipment or owner of a company that owns the Equipment) and that Operator shall be deemed to be Your employee and acting under Your supervision or control for all purposes and shall be covered as an insured on all of Your applicable insurance policies.

  • Operator The Optionee shall be the operator for purposes of developing and executing exploration programs.

  • Operations Fire An “Operations Fire” is a fire caused by Purchaser’s Operations other than a Neg- ligent Fire. Forest Service, except as provided in B7.3, shall use cooperative deposits under B4.218 to perform fire sup- pression activities on Operations Fires. Xxxxxxxxx agrees to reimburse Forest Service for such cost for each Opera- tions Fire, subject to a maximum of the dollar amount stated in A14. The cost of Purchaser’s actions, supplies, and equipment on any such fire provided pursuant to B7.3, or otherwise at the request of Forest Service, shall be credited toward such maximum. If Purchaser’s actual cost exceeds Purchaser’s obligation stated in A14, Forest Service shall reimburse Purchaser for the excess.

  • Procurement and Property Management Standards The parties to this Agreement shall adhere to the procurement and property management standards established in 2 CFR 200, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, and to the Texas Uniform Grant Management Standards. The State must pre-approve the Local Government’s procurement procedures for purchases to be eligible for state or federal funds.

  • Geotechnical Services Engineer will obtain all necessary subsurface investigations, tests, reports, and perform related surveys.

  • As-Builts Seller shall provide final as-built drawings of the Seller-Owned Interconnection Facilities within 30 Days of the successful completion of the Acceptance Test.

  • As-Built Plans Within thirty (30) days after completion of Tenant’s Changes requiring the submission of plans to Landlord, Tenant shall furnish to Landlord a complete set of “as-built” plans and specifications.

  • Operations Logs Seller shall maintain a complete and accurate log of all material operations and maintenance information on a daily basis. Such log shall include, but not be limited to, information on power production, fuel consumption, efficiency, availability, maintenance performed, outages, results of inspections, manufacturer recommended services, replacements, electrical characteristics of the generators, control settings or adjustments of equipment and protective devices. Seller shall maintain this information for at least two (2) years and shall provide this information electronically to Buyer within one day of Buyer’s request.

  • BUYER'S FACILITIES 1. Buyer will maintain at its own expense facilities from the delivery point to the point of use and the burners and equipment for using gas, and Buyer will at all times keep gas-using equipment on said premises in a condition conforming with such reasonable rules and regulations as may be prescribed therefore by regulatory authority having jurisdiction thereover and with the requirements of any valid law thereto appertaining. In the event that rules are not prescribed by a regulatory authority, Buyer will abide by codes as used in the gas industry.
