Common use of Order of Reduction and Bumping Clause in Contracts

Order of Reduction and Bumping. Provided the employee, as determined by the Institute, is qualified for the applicable positions, taking into consideration the objective standards of the employee’s skills and abilities and whether the employee could be qualified with four (4) weeks of orientation, displaced employees in order of highest seniority may elect to do the following: a) Take a vacant comparable position within his or her clinical group; b) Bump the least senior employee within his or her clinical group with a comparable position; c) If no comparable position within his or her clinical group is available, the employee may take a vacant comparable position for which she or he is qualified or bump the least senior employee with a comparable position for which she or he is qualified; d) If no comparable position is available, the employee may choose to take a vacant position with fewer hours for which he or she is qualified, bump the least senior employee with fewer hours for which she or he is qualified or be laid off.
