RECOGNITION AND MEMBERSHIP. ‌ 24 1.1 Bargaining Unit The Hospital recognizes the Association as the collective 25 bargaining representative with respect to rates of pay, hours of pay, hours of work, and 26 other conditions of employment for a bargaining unit composed of all registered 27 professional nurses employed by the Hospital as general duty nurses and charge 28 nurses, excluding administrative and supervisory personnel, nursing unit 29 supervisors/managers/directors, managers, and registered professional nurses not 30 employed in direct patient nursing service. 32 1.2 Membership Membership in the American Nurses Association (XXX) 33 through the Association shall not be required as a condition of employment. Nurses who 34 are currently members of the Association will be required as a condition of continued 35 employment during the term of this Agreement to either maintain their membership or 1 contribute a sum equal to the Association dues to the Hospital foundation. All nurses 2 covered by this Agreement except college instructors working during the summer 3 months only must, after 30 days from the nurse's first day of work or the effective date 4 of this Agreement, whichever is later, as a condition of continued employment, either 5 become a member of the Association or make a monthly fair share payment. 6 1.2.1 Fair Share Payment The monthly fair share payment shall be as 7 established by the Association, but in no event shall be greater than the monthly 8 dues paid by members of the Association. Fair share payment shall be made to 9 the Association or, for persons with religious objections, to the Hospital 10 Foundation. 12 1.2.2 Dues Deduction The Hospital will deduct Association membership 13 dues or fair share contributions from the salary of each nurse who voluntarily 14 agrees to such deductions and who submits an appropriately written 15 authorization form to the Hospital. Deductions shall be made monthly and 16 remitted to the Association together with the name of those authorizing 17 deductions.
RECOGNITION AND MEMBERSHIP. 2.01 The Hospital recognizes the Association as the collective bargaining representative with respect to rate of pay, hours of work, and other conditions of employment for a bargaining unit composed of all registered nurses employed by the Hospital only at 13th and May Streets, Hood River, Oregon, and no other location as general duty nurses, but excluding administrative and supervisory personnel and nurses employed exclusively in the following departments and areas: Admissions, Physical Therapy, EEG, Anesthesia, Radiology, Laboratory, Pharmacy, Occupational Therapy, Quality Assurance, Utilization Review, Nursing Education, Dietary, Medical Records, Personnel, Doctor's Offices, and Housekeeping. Should the Hospital move nurses currently within the bargaining unit to a location contiguous with the Hospital property but not specifically located at 13th and May Streets, those positions will remain within the bargaining unit. 2.02 The Hospital also recognizes the Association as the collective bargaining representative with respect to rate of pay, hours of work, and other conditions of employment for all registered nurses employed in the Home Health Care and Hospice Departments as general-duty nurses, but excluding administrative and supervisory personnel. 2.03 Because a nurse has a high degree of professional responsibility to the patient, the nurse is encouraged to participate in the Association to define and upgrade standards of nursing practice and education through participation and membership in his/her professional association. An ONA membership packet will be provided by ONA to the Hospital. The Hospital will provide that packet to each nurse at the time of new employee orientation. A bargaining unit nurse designated by the Association will be given the opportunity to meet with newly-hired nurses who are on paid time for 15 minutes, to discuss contract administration. The meeting will occur within the first week of employment. If the nurse designated by the Association has been released from otherwise scheduled work, the nurse will also be paid for the 15-minute period. 2.04 The following provisions apply to any nurse hired before December 14, 2009 (“Effective Date”): Membership in the American Nurses Association through Association shall be encouraged, although it shall not be required as a condition of employment. The Hospital also agrees not to assign 21 supervisory duties to bargaining unit nurses on an ongoing basis. Such duties 22 would include, but are not limited to, the ability to hire, transfer, suspend, layoff, 23 recall, promote, discharge, reward or discipline, adjust employment grievances, 24 independently evaluate other employees or otherwise responsibly direct other 25 employees with respect to their employment with the Hospital. The parties do not 26 consider routine monitoring, clinical guidance, providing written and/or oral input for 27 evaluation of other employees’ performance, peer evaluation, and professional 28 direction of employees to whom bargaining unit nurses delegate nursing tasks, 29 assigning professional responsibilities, preparing unit draft schedules, or performing

RECOGNITION AND MEMBERSHIP. Section 1.1. The Institute recognizes the Association as the collective bargaining representative of Case Managers and Registered Nurses employed as registered nurses in the Institute, and Social Workers employed in the Institute with respect to wages, hours, and working conditions. The bargaining unit includes any employees in the following positions: Per Diem Nurse, Per Diem Case Manager, Per Diem Social Worker, Per Diem Infection Control Nurse, Per Diem Diabetic Educator, Nurse 1, 2, and 3, Infection Control Nurse, External Case Manager, Internal Case Manager, Social Worker, Clinical Consultant, Charge Nurse, Wound Care Nurse and Diabetic Educator (hereinafter collectively referred to as “employees”). Nurse Managers, Assistant Nurse Managers, temporary nurses, agency nurses, all other employees, guards and supervisors are excluded from the bargaining unit. Section 1.2. This recognition is limited to Institute operations currently at 000 Xxxxx Xxxxxx, Spokane, Washington, and does not apply to employees working in any other present or future operations of the Institute.
