The City and Xxxx acknowledge and agree that construction of the Improvements is not intended to be considered “public works” subject to ORS 279C.800 to 279C.875 and the administrative rules adopted thereunder. Any elements of the Improvements constructed by the City may qualify as public works projects and may be subject to prevailing wage rates.
