Overadvance Fees. The Borrower shall pay an Overadvance fee in the amount of $500.00 for each day or portion thereof during which an Overadvance exists, regardless of how the Overadvance arises or whether or not the Overadvance has been agreed to in advance by the Lender. The acceptance of payment of an Overadvance fee by the Lender shall not be deemed to constitute either consent to the Overadvance or a waiver of the resulting Event of Default, unless the Lender specifically consents to the Overadvance in writing and waives the Event of Default on whatever conditions the Lender deems appropriate.
Overadvance Fees. Company shall pay a $500 Overadvance fee for each day that an Overadvance exists which was not agreed to by Xxxxx Fargo in an Authenticated Record prior to its occurrence; provided that Xxxxx Fargo’s acceptance of the payment of such fees shall not constitute either consent to the Overadvance or waiver of the resulting Event of Default. Company shall pay additional Overadvance fees and interest in such amounts and on such terms as Xxxxx Fargo in its sole discretion may consider appropriate for any Overadvance to which Xxxxx Fargo has specifically consented in an Authenticated Record prior to its occurrence.
Overadvance Fees. In addition to other interest and charges provided herein, an Overadvance fee in an amount of not less than three percent (3%) of the average balance of any Overadvances that may exist during any month, payable monthly in arrears; provided that Lender’s acceptance of the payment of such fees shall not constitute either consent to the Overadvance or waiver of the resulting Event of Default.

Except in those instances in which an Overadvance results due to a Xxxxx Fargo calculation error, Companies shall pay a $500 Overadvance fee for each day that an Overadvance exists which was not agreed to by Xxxxx Fargo in an Authenticated Record prior to its occurrence if such Overadvance is not repaid or otherwise eliminated within five (5) Business Days of when it first arises (and, for sake of clarity, if such Overadvance is not so repaid or eliminated within such five (5) Business Day period, such $500 per day fee shall accrue and be payable from the first day that the Overadvance was outstanding); provided that Xxxxx Fargo’s acceptance of the payment of such fees shall not constitute either consent to the Overadvance or waiver of the resulting Event of Default. Companies shall pay additional Overadvance fees and interest in such amounts and on such terms as Xxxxx Fargo in its sole discretion may consider appropriate for any Overadvance to which Xxxxx Fargo has specifically consented in an Authenticated Record prior to its occurrence.
Overadvance Fees. The Borrower shall pay an overadvance fee in the amount of $100 for each day or portion thereof that the Revolving Advances exceed the Borrowing Base, provided however, that if any such day occurs during a Default Period, the overadvance charge for such day shall be $200.
Overadvance Fees. The Borrower shall pay a fee for each Overadvance in the minimum amount of $1,000.00 for each day or portion thereof that Revolving Advances exceed the Borrowing Base, regardless of how the Overadvance arises or whether or not the Overadvance has been agreed to in advance by Lender; provided, however, that payment of any such Overadvance fee shall not be deemed to constitute either consent to the Overadvance or the waiver of any Event of Default arising as the result of an Overadvance not otherwise consented to in advance by Lender.

The Companies shall jointly and severally pay an Overadvance fee for each day that an Overadvance exists which was not agreed to by Wxxxx Fargo in an Authenticated Record prior to its occurrence; provided that Wxxxx Fargo's acceptance of the payment of such fees shall not constitute either consent to the Overadvance or waiver of the resulting Event of Default. The Companies shall pay additional Overadvance fees and interest in such amounts and on such terms as Wxxxx Fargo in its sole discretion may consider reasonably appropriate for any Overadvance to which Wxxxx Fargo has specifically consented in an Authenticated Record prior to its occurrence. Wxxxx Fargo shall provide notice to the Companies of the amount of any such Overadvance fee once determined as described in this clause (f).
Overadvance Fees. The Borrowers shall pay an Overadvance fee in the amount of One Thousand Dollars ($1,000) for each day during which an Overadvance exists, regardless of how the Overadvance arises or whether or not the Overadvance has been agreed to in advance by the Lender; provided, however, that from the first day of any month during which any Default Rate commences or exists at any time, the daily Overadvance charge (if an Overadvance exists) shall be Two Thousand Dollars ($2,000). The acceptance of payment of an Overadvance fee by the Lender shall not be deemed to constitute either consent to the Overadvance or the waiver of the resulting Event of Default, unless the Lender specifically consents to the Overadvance in writing that waives the Event of Default on whatever conditions the Lender deems appropriate.
