Overdraft Liability. The following actions may be taken by us if we receive a draft or other item drawn against your account and there are insufficient funds based on the available balance in your account to cover the draft or item: • Cover the draft or item in accordance with the terms of any written overdraft plan that you have established with us. • Pay the draft or item and create an overdraft to your account. Any negative balance on your account is immediately due and payable, unless we agree otherwise in writing. We may place a hold on balances in any other account you have with us until the overdraft is paid or we may set-off the amount of the overdraft against any of your other accounts in accordance with the terms of this agreement, unless prohibited by applicable law. • Return the draft or item unpaid. We may, at our option and without notice to you, refuse to pay any draft or item if it would create an overdraft, even though we may have previously established a pattern of honoring such drafts or items. We have no obligation to notify you before we decide to either pay a draft or item that creates an overdraft or to dishonor a draft or item that is drawn against insufficient available funds. Drafts or other transfers or payment orders that are drawn against insufficient funds may be subject to a service charge set forth in the Fee Schedule. National Automated Clearing House Association (NACHA) Rules allow Originating Depository Financial Institutions to reinitiate/resubmit an ACH debit returned due to NSF or uncollected funds up to two times. If the same draft or other transfer or payment order is submitted a second time, and there are insufficient funds in the account, it may be returned unpaid a second time with a fee assessed on the same item a second time. If we pay a draft or item against insufficient available funds or an overdraft is otherwise created on the account, you agree to pay any overdraft immediately. You agree to reimburse us for the cost and expenses we incur in recovering the overdraft from you, including our reasonable attorney’s fees and court costs.

Overdraft Liability. If on any day, you do not have adequate funds in your checking account to cover checks, fees, or other items drawn on your account, including, but not limited to ATM withdrawals, Visa Debit Card transactions, preauthorized debits, or Point-of-Sale (POS) transactions (due to non-sufficient funds, uncollected funds, or postdating), we will process those amounts according to our overdraft procedures or an overdraft line-of-credit account that you have set up. We may ascertain that an account lacks sufficient funds to cover an item any time we attempt to process the item. Only one review of the account balance is required during that time. We are not required to inform you if your checking account lacks sufficient funds to cover an item. Regardless of whether we pay the item or reject it, you agree to pay any fee we may assess to your account as stated in the Fee Schedule. Except as noted in a written agreement, we, by paying one or any overdraft, do not consent to honor overdrafts in the future and may cease paying overdrafts at any time without notice. If we cover a check or charge a fee that would overdraw your account, you promise to repay the overdrawn amount to us immediately. We have the right to seek collection of earlier dishonored items not covered at any time, including granting a payer bank additional time past any deadline.
Overdraft Liability. We may, at our option without notice to you, pay or refuse to pay any item if it would cause your Account to be overdrawn, without regard to whether we may have previously honored or dishonored such an item. Your Account is considered overdrawn when its ledger balance is negative. This may occur when items are presented to us for payment and there are insufficient funds in your Account to cover the item, and we make the decision to pay the item. Your Account also may become overdrawn if there are insufficient funds to cover account maintenance fees, service fees or returned items. You agree that any overdraft on your Account is immediately due and payable and you agree to reimburse us for any costs and expenses (including attorney’s fees) we incur for recovering the overdraft and any related fees and interest, whether you signed or initiated the item that created the overdraft or not and whether you benefited from the proceeds of the item creating the overdraft or not. On a Business Day when we determine there are sufficient funds in your Account to pay one or more (but not all) items presented for payment on your Account, the order in which we post such items may affect the number of items paid and the overdraft and returned item fees assessed. You can avoid fees for overdrafts and returned items by making sure that your Account ledger balance is sufficient to cover your outstanding transactions. We recommend that you enroll in an optional overdraft protection plan, such as the Commercial Credit Sweep Service. Information on our overdraft protection plans is available in the ”Overdraft Protection for Corporate Accounts.”

If we have approved an overdraft line of credit or overdraft privilege plan for your account, we will honor drafts drawn on insufficient funds as required under the Credit Union's overdraft line of credit or overdraft privilege plan. The fee for overdraft transfers, if any, is set forth on the Fee Schedule. This Agreement governs all transfers, except those governed by agreements for loan accounts.
