Common use of Overpayments Clause in Contracts

Overpayments. 19 Any payment(s) made by COUNTY to CONTRACTOR in excess of that to which 20 CONTRACTOR is entitled under this Agreement shall be repaid to COUNTY, in accordance with 21 any applicable regulations and/or policies in effect during the term of this Agreement, or as 22 established by COUNTY procedure. Any overpayments made by COUNTY which result from a 23 payment by any other funding source shall be repaid, at the discretion of ADMINISTRATOR, to 24 COUNTY or the funding source. Unless earlier repaid, CONTRACTOR shall make repayment 25 within thirty (30) days after the date of the final audit findings report and prior to any 26 administrative appeal process. In the event an overpayment owing by CONTRACTOR is collected 27 from COUNTY by the funding source, then CONTRACTOR shall reimburse COUNTY within 28 thirty (30) days thereafter and prior to any administrative appeal process. CONTRACTOR agrees 1 to pay all costs incurred by COUNTY necessary to enforce the provisions set forth in this 2 Paragraph.

Overpayments. 19 7 Any payment(s) made by COUNTY to CONTRACTOR in excess of that to which 20 8 CONTRACTOR is entitled under this Agreement shall be repaid to COUNTY, in 9 accordance with 21 any applicable regulations and/or policies in effect during 10 the term of this Agreement, or as 22 established by COUNTY procedure. Any 11 overpayments made by COUNTY which result from a 23 payment by any other funding 12 source shall be repaid, at the discretion of ADMINISTRATOR, to 24 COUNTY or the 13 funding source. Unless earlier repaid, CONTRACTOR shall make repayment 25 within 14 thirty (30) days after the date of the final audit findings report and prior 15 to any 26 administrative appeal process. In the event an overpayment owing by 16 CONTRACTOR is collected 27 from COUNTY by the funding source, then CONTRACTOR 17 shall reimburse COUNTY within 28 thirty (30) days thereafter and prior to any 18 administrative appeal process. CONTRACTOR agrees 1 to pay all costs incurred by 19 COUNTY necessary to enforce the provisions set forth in this 2 Paragraph.
