Current Employees. Employees who are eligible to participate but not deferring shall have Elective Deferrals withheld in the amount of ______ % of Compensation or $_________ of Compensation. Employees and Participants shall have the right to amend the stated automatic Elective Deferral percentage or receive cash in lieu of deferral into the Plan.

i. On an annual basis the Elective Deferral rate under the Plan shall be increased up to a maximum amount determined by the Employer.
ii. After _____ Years of Service, the amount specified above shall increase to _____% (no more than 10%) or $_______ [may be no more than the Code Section 402(g) limit and Code Section 414(v) limit, if applicable].
Current Employees. (a) If an employee is overpaid, the employer will have the right to recover such an overpayment.
(b) Where the employer seeks to recover such an overpayment the employer will contact the employee in writing to request that a mutually acceptable repayment schedule be agreed.
(c) In the event that a repayment schedule has not been agreed after twenty-eight (28) days from the date of the written request, the employer will have the right to deduct money from the employee’s ordinary wages subject to the following:
(i) any deduction shall not reduce the employee’s fortnightly wage to less than either the minimum wage, or seventy-five per cent (75%) of the employee’s gross fortnightly income, whichever is greater;
(ii) the minimum period over which the deductions can be made is thirteen (13) pay periods; and
(iii) any deductions will be made in equal instalments in each pay period, except for the final instalment which may be less than the preceding instalments.
Current Employees. Current employees who change classification and successfully complete the required probationary period shall be reimbursed their prorated/contributed cost of the benefits he/she selects. Proration will be based on hours worked prior to the change of classification.
Current Employees. Where the employer seeks to recover an overpayment, the employer may contact the employee in writing to request that a reasonable repayment schedule be agreed to deduct monies from the employer payments to the employee in relation to the performance of work to recover the overpayment.
Current Employees. After the first issue of uniforms, employees who are provided 34 purchased uniforms shall have the opportunity to select approved accessories provided that 35 the basic uniform is in good condition and that the total price of accessories does not exceed 36 the cost of the uniforms.
Current Employees. Current employees who are not employed as bus 22 operators in the Transportation Department may be transferred to the 23 Transportation Department without serving as a substitute, if they meet all other 24 eligibility requirements and a vacancy exists. An eligible transferred employee’s 25 seniority date shall be the date of the personnel action form (PAF) which reflects 26 the Transportation Department’s recommendation for transfer to the 27 Superintendent.
