Common use of Overtime Intermissions and Meals Clause in Contracts

Overtime Intermissions and Meals. It is the intent that the employees will be provided with a meal and an intermission break by the Employer during overtime work at intervals of four hours, that is, four hours elapsed time from the end of the prior meal. Employees who have earned and take a paid meal intermission may claim reasonable costs for an overtime meal, once daily and with a receipt, up to $42.00 all-inclusive (effective July 10, 2015). A meal intermission which occurs during any overtime period shall be paid for at the prevailing rate, provided such intermission is not more than thirty (30) minutes’ duration. However, no meal shall be provided to an employee in instances where the employee works only two hours or less beyond their normal day or shift. When it is impossible to have meals supplied, or when an employee works through their overtime meal intermission, or they have already claimed a receipted overtime paid meal intermission, an employee will be paid three-quarters (3/4) of an hour at prevailing rates for each meal to which they would otherwise have been entitled. As an exception to the paragraph above, employees working overtime on non-regular working days may claim receipted meals more than once daily provided any subsequent meal claims do not exceed $26.00, all- inclusive (effective July 10, 2015). Where work is pre-scheduled for non-regular working days and employees have been notified on the previous normal working day and work is to commence within two hours of the normal starting time the Employer will not be required to provide lunch.
