Owner Review of Claim Sample Clauses

Owner Review of Claim. Upon receipt of a Claim, the Owner shall review the Claim and, within a period not to exceed forty-five (45) days, shall provide Design-Builder a written statement identifying what portion of the Claim is disputed and what portion is undisputed. Upon receipt of a Claim, the Owner and the Design-Builder may, by mutual written agreement, extend the forty-five (45) day time period. The Owner shall process and make payment of any undisputed portion of a Claim within sixty (60) days after the Owner issues its written statement. Failure by the Owner to provide a written statement in response to a Claim from the Design-Builder within the forty- five (45) day time period, or within an agreed upon extended time period, shall result in the Claim being deemed rejected in its entirety. A Claim that is rejected by reason of the Owner’s failure to respond, or failure to timely respond, to the Claim shall not constitute an adverse finding regarding the merits of the Claim or the claimant’s responsibility or qualifications.

Owner Review of Claim. Within 45 days after receiving a complete Contract Claim, Agency shall review the claim and provide the Contractor a written statement identifying what portion of the claim is disputed and what portion is undisputed. Agency will pay any undisputed portion of the claim within 60 days from the date of the written statement. If Agency fails to timely issue a written statement, the claim shall be deemed rejected in its entirety.
