Participating Settlement. Class Members who submit a valid Claim with Proof of Purchase are eligible for reimbursement up to a maximum of one hundred percent (100%) of the amount for which they provide Proof of Purchase.
Participating Settlement. Class Members who submit a valid Claim without Proof of Purchase are eligible for reimbursement of up to five dollars ($5.00) per household.
Participating Settlement. Class Members shall have 320 days after the date the Individual Settlement Allocation checks are mailed by the Settlement Administrator to cash their Individual Settlement Allocation checks (the “Settlement Check Cashing Deadline”). Any Individual Settlement Allocation check that is not cashed by the Settlement Check Cashing Deadline shall become void and subject to a stop payment order. No sooner than 45 days and no later than 60 days after the Settlement Check Cashing Deadline, the Settlement Administrator shall tender any funds from uncashed checks to the Washington State Department of Revenue’s Unclaimed Property program to be held there in the name of and for the benefit of such Participating Settlement Class Members under Washington’s unclaimed property laws. In such event, those Participating Settlement Class Members will be deemed to have waived irrevocably any right in or claim to a payment or settlement share in excess of what is available from the Unclaimed Property program, but the Settlement Agreement nevertheless will be binding upon them.
Participating Settlement. Class Members who do not provide their preferred method of electronic disbursement for monetary benefits or do not provide valid mailing addresses for purposes of check receipt of monetary benefits shall be deemed to have forfeited their Claim.. Such Participating Settlement Class Members will remain in the Settlement and be bound by its terms, including releases, and the Judgment.
