Parties’ Expenses. The Parties shall each carry and pay all their respective costs, charges and expenses incurred by it in the performance of this Agreement, except as otherwise may be agreed-upon by the Parties in writing in advance.
Parties’ Expenses. Except as otherwise provided herein, the Xxxxxx Xxx Parties and their respective counsel shall not charge any fees or expenses to the Settlement Fund. All other costs not provided for herein that Defendants incur relating to the Settlement shall be borne by Xxxxxx Xxx. All other costs not provided for herein that the Plaintiffs or the Settlement Class incur relating to the Settlement shall be borne by Plaintiffs.
Parties’ Expenses. Except as otherwise provided for herein, Defendants and Defense Counsel shall not charge any fees or expenses to the Settlement Fund. All other costs not provided for herein that Defendants incur relating to the Settlement shall be borne by Defendants or Defendants’ Insurer. All other costs not provided for herein that the Named Plaintiff incur relating to the Settlement shall be borne by Named Plaintiff. To the extent any Settlement Class Member bears any costs associated with this Settlement Agreement, such costs shall be borne solely by the Settlement Class Member who incurs such costs.
Parties’ Expenses. Buyer and Seller shall each bear their own costs and expenses related to the Inventory Audit, including without limitation the cost of certified public accountants or employees of Buyer or Seller present at any Store or Warehouse during the Physical Count of the Inventory, the wages of their own employees and any "extras" who assist in the performance or evaluation of the Inventory Audit.
Parties’ Expenses. Except as otherwise provided in this Agreement, each Party will bear its respective fees and expenses incurred in connection with the preparation, negotiation, execution and performance of this Agreement and the transactions contemplated hereby.
