PATHWAY ACTIVITIES. The collaborative pathway activities undertaken by Snuneymuxw First Nation and the City of Nanaimo included the following. $ $ Protocol and Communications Agreements Joint Economic Development Initiatives Shared Tourism Projects Servicing Agreements and Infrastructure PROJECT OVERVIEW The City of Nanaimo and Snuneymuxw First Nation began to officially recognize their government-to-government relationship through a written agreement in the early 2000s. The Memorandum of Understanding (MOU) signed in 2005 established the governments’ duty to mutual respect and cooperation between each other and a commitment to a set of principles to guide the government to government relationship. Next, a Protocol Agreement signed in 2009 outlined the governments’ responsibilities to work together and coordinate economic opportunities, service provision, land use planning, and established a joint decision-making process. Nonetheless, communication challenges occurred between the governments. Tensions peaked in 2017 when Snuneymuxw removed their flag from the Nanaimo city hall, symbolizing a breakdown in the relationship. Despite relationship challenges, this event was a catalyst for engagement and further discussions acknowledging their 2005 and 2009 commitments. In early 2019, the governments prioritized the revision of the 2009 Protocol Agreement to focus more on deepening the understanding of each other including the Treaty of 1854, advancing reconciliation and commit to a shared vision for the Nanaimo region. Signed in May of 2019, the renewed Protocol Agreement affirms both governments’ essential role in decision-making for the well-being of the Nanaimo region and promotes a shared vision of reconciliation and collaboration.   • Promotional Activities ‌ 19 At the request of North Sound BH-ASO, Provider shall display promotional materials in its 20 offices and facilities as practical, in accordance with applicable law and cooperate with and 21 participate in all reasonable marketing efforts.   • Marketing Activities The Borrower will not, and will not permit any of its Subsidiaries to, engage in marketing activities for any Hydrocarbons or enter into any contracts related thereto other than (i) contracts for the sale of Hydrocarbons scheduled or reasonably estimated to be produced from their proved Oil and Gas Properties during the period of such contract, (ii) contracts for the sale of Hydrocarbons scheduled or reasonably estimated to be produced from proved Oil and Gas Properties of third parties during the period of such contract associated with the Oil and Gas Properties of the Borrower and its Subsidiaries that the Borrower or one of its Subsidiaries has the right to market pursuant to joint operating agreements, unitization agreements or other similar contracts that are usual and customary in the oil and gas business and (iii) other contracts for the purchase and/or sale of Hydrocarbons of third parties (A) which have generally offsetting provisions (i.e. corresponding pricing mechanics, delivery dates and points and volumes) such that no “position” is taken and (B) for which appropriate credit support has been taken to alleviate the material credit risks of the counterparty thereto.

  • CONCERTED ACTIVITIES 24.1 It is agreed and understood that there will be no strike, work stoppage, slow-down, or refusal or failure to fully and faithfully perform job functions and responsibilities, or other interference with the operations of the District by the Federation, or by any of the Federation's officers, agents, or members during the term of this Agreement, including compliance with the request of other labor organizations to engage in such activity.
