Payment For and Protection of Materials. 4.4.1 Contractor shall make prompt payment to anyone furnishing labor, material, services, or equipment to Contractor for the project. Such prompt payment is of the essence. In all cases of nonpayment by Contractor, Owner is authorized, at Contractor’s expense, to make such payments and to deduct the amount of any and all such payments from amounts to be paid by Owner to Contractor. Owner shall not, however, have any duty to make such payments. Contractor shall be responsible for the care and protection of all equipment and materials necessary for the performance of the Contract from the time they are delivered by or for it on the job site until the work is completed and is accepted by Owner.

  • Distribution of Materials You will keep an accurate record of the names and addresses of all persons to whom you give copies of the Registration Statement, the Prospectus, any Preliminary Prospectus (or any amendment or supplement thereto) or any Offering Circular or any Preliminary Offering Circular and, when furnished with any subsequent amendment to the Registration Statement, any subsequent Prospectus, any subsequent Offering Circular or any memorandum outlining changes in the Registration Statement or any Prospectus or Offering Circular, you will, upon request of the Manager, promptly forward copies thereof to such persons.

  • Contractor Designation of Trade Secrets or Otherwise Confidential Information If the Contractor considers any portion of materials to be trade secret under section 688.002 or 812.081, F.S., or otherwise confidential under Florida or federal law, the Contractor must clearly designate that portion of the materials as trade secret or otherwise confidential when submitted to the Department.
