Payment from Settlement Fund. Any attorneys’ fees and litigation expenses awarded by the Court in connection with Final Approval of this settlement shall be paid out of the Settlement Fund to Plaintiffs’ Counsel for distribution at the sole discretion of Co- Lead Class Counsel.

Payment from Settlement Fund. 89. Within five days after AGLIC transfers the Settlement Amount into the Settlement Fund, the Settlement Administrator shall issue payment from the Settlement Fund for Class Notice and Administration Costs, Litigation Expenses awarded by the Court, attorneys’ fees awarded by the Court, Incentive Awards, and any other costs or fees approved by the Court.

Related to Payment from Settlement Fund

  • Qualified Settlement Fund The Administrator shall establish a settlement fund that meets the requirements of a Qualified Settlement Fund (“QSF”) under US Treasury Regulation section 468B-1.

  • The Settlement Fund 37. Releasors shall look solely to the Settlement Fund for settlement and satisfaction of all Released Claims against the DENSO Defendants and the Releasees, and shall have no other recovery against the DENSO Defendants or any other Releasee for any Released Claims.

  • Termination of Settlement If the Settlement is terminated as provided in the Stipulation, the Settlement is not approved, or the Effective Date of the Settlement otherwise fails to occur, this Order shall be vacated, rendered null and void and be of no further force and effect, except as otherwise provided by the Stipulation, and this Order shall be without prejudice to the rights of Plaintiffs, the other Settlement Class Members and Defendants, and the Parties shall revert to their respective positions in the Action as of December 12, 2019, as provided in the Stipulation.

  • Gross Settlement Amount Except as otherwise provided by Paragraph 10 below, Defendant promises to pay $2,250,000.00 and no more as the Gross Settlement Amount and to separately pay any and all employer payroll taxes owed on the Wage Portions of the Individual Class Payments. Defendant has no obligation to pay the Gross Settlement Amount (or any payroll taxes) prior to the deadline stated in Paragraph 4.3 of this Agreement. The Administrator will disburse the entire Gross Settlement Amount without asking or requiring Participating Class Members or Aggrieved Employees to submit any claim as a condition of payment. None of the Gross Settlement Amount will revert to Defendant.
