Payment of Ad Valorem Taxes. All Ad Valorem Taxes shall be paid by January 31 of each tax year for the Village Center, unless being protested in accordance with Texas law. For clarity, Ad Valorem Taxes which are not being protested shall still be paid by January 31. Payment will not be required only for the portion of Ad Valorem Taxes which are being protested in accordance with Texas law.

Payment of Ad Valorem Taxes. If Economic Development Property becomes subject to ad valorem taxes as imposed by law pursuant to the terms of this Fee Agreement or the Act, then the calculation of the ad valorem taxes due with respect to the Economic Development Property in a particular property tax year shall: (i) include the property tax reductions that would have applied to the Economic Development Property if it were not Economic Development Property; and (ii) include a credit for FILOT Payments the Sponsor has made with respect to the Economic Development Property.
