Payments in Lieu of Vacation. (a) In the event of an employee's resignation or other termination of employment, other than termination for misconduct, before using all the vacation which the employee is eligible to accrue under Section 9.05 (Vacation Eligibility), an amount equivalent to such unused accrued vacation shall be paid to the employee or his or her beneficiary or estate. In the event of an employee’s termination for misconduct, the employee waives and forfeits any right (s)he may have to receive pay for vacation accrued at the time of termination including any rights under California Labor Code Section 227.3 or any similar law in another state.
