Payroll Deductions. The Board shall provide payroll deductions as outlined below:
A. ORGANIZATION DUES/REPRESENTATION FEE
1. The Board shall make a payroll deduction as authorized by the teacher for membership dues in the Allegany County Teachers Association (ACTA) and its affiliates have the exclusive right affiliates, or for a representation fee as required per A.8 below.
2. The deduction will be taken each pay period during which such authorization is effective. A maximum of automatic payroll deduction of membership dues, assessments, and fees two (2) deductions per month will be deducted for certificated employees who voluntarily join the Associationa ten-month pay period.

The certificated employee may choose to sign and deliver such authorization to the Association during the enrollment period at the beginning of the school year. In the event that any teacher chooses not to sign and deliver the appropriate automatic payroll authorization form to the Association, the District agrees to deduct from the salary of such teacher a representative fee in an amount equal to membership dues and assessment less the deductions for NEA-PAC; provided, however those teachers who have joined the Association and paid by means other than payroll deduction, as verified by the monthly Association list, shall not be subject to this deduction. Representation fee deductions shall be handled and transmitted by the Business Office in the same fashion as membership deductions as provided for in this Section. Any teacher claiming bona fide religious objection shall notify the Association and the Business Office of such objection in writing within 30 days of commencement of employment. Pending determination of a bona fide religious objection, the Business Office agrees to deduct from the salary of the teacher claiming such objection, an amount equivalent to the Association dues and assessments. However, said monies shall not be transmitted until such time as the Business Office is notified that a final determination pursuant to the act has been made. In the event that it is finally determined that the teacher does not have a bona fide religious objection, the Business Office agrees to remit promptly to the Association all monies being held as deductions from that teacher’s salary for Association dues and assessments. In the event that a teacher has been determined to have a bona fide religious objection to the payment of a representation fee or agency shop fee, said teachers shall pay an amount of money equivalent to regular Association dues and assessments to a designated charitable organization as mutually agreed to by the employee and the Association. Within thirty (30) dais of the commencement of employment or determination of bona fide religious objection, whichever occurs later, said teacher may sign and deliver to the Business Office a Representation Fees Check-Off Authorization and Assessment form which is attached hereto as Appendix G and incorporated in the Agreement, which shall authorize the deduction of an amount equal to the Association dues and assessments and payment in installments as hereinabove provided, including any deductions made but not previously transmitted to said designated charitable organization. The Business Office agrees to remit to the Association each month, a list of the teachers on behalf of whom charitable deductions have been made.

In the event that any teacher chooses not to sign and deliver the appropriate automatic payroll authorization form to the Association, the District agrees to deduct from the salary of such teacher a representative fee in an amount equal to membership dues and assessment less the deductions for NEA-PAC; provided, however those teachers who have joined the Association and paid by means other than payroll deduction, as verified by the monthly Association list, shall not be subject to this deduction. Representation fee deductions shall be handled and transmitted by the Business Office in the same fashion as membership deductions as provided for in this Section. Any teacher claiming bona fide religious objection shall notify the Association and the Business Office of such objection in writing within 30 days of commencement of employment. Pending determination of a bona fide religious objection, the Business Office agrees to deduct from the salary of the teacher claiming such objection, an amount equivalent to the Association dues and assessments. However, said monies shall not be transmitted until such time as the Business Office is notified that a final determination pursuant to the act has been made. In the event that it is finally determined that the teacher does not have a bona fide religious objection, the Business Office agrees to remit promptly to the Association all monies being held as deductions from that teacher’s salary for Association dues and assessments. In the event that a teacher has been determined to have a bona fide religious objection to the payment of a representation fee or agency shop fee, said teachers shall pay an amount of money equivalent to regular Association dues and assessments to a designated charitable organization as mutually agreed to by the employee and the Association. Within thirty (30) days of the commencement of employment or determination of bona fide religious objection, whichever occurs later, said teacher may sign and deliver to the Business Office a Representation Fees Check-Off Authorization and Assessment form which is attached hereto as Appendix G and incorporated in the Agreement, which shall authorize the deduction of an amount equal to the Association dues and assessments and payment in installments as hereinabove provided, including any deductions made but not previously transmitted to said designated charitable organization. 6. Employees who are members of the Washington School Employees Credit Union of Washington or other similar financial institutions may authorize payroll deduction for Credit Union activities by presenting an authorization the deductions.
7. The SEA agrees to indemnify and save the SPS harmless against any expense liability which may arise by reason on any action taken by the SPS to comply with the provisions of this Article IX,D, including reimbursement for any legal fees or expenses incurred should it choose in connection therewith. Payroll Deductions. The District shall deduct from the salaries of the unit members at the unit member's request, the following: dues of Association members, premiums for Board approved health and welfare benefits, tax sheltered annuities (TSA) which the District has approved, and contributions to United Way.
4.8.1 UNION MEMBER DUES
a. Any unit member may enter into an agreement with the Association to provide authorization for the district to make a deduction request in writing the unit member's regular Association membership dues to be deducted from the unit member's salary or wages to pay dues, fees, any any other authorized deductions to the Association or its affiliated organizations or entities. The first monthly deduction shall be made on the following pay date after the authorization is received. Such authorization shall continue in effect until the unit member revokes the authorization in the manner provided by the terms of that agreement, or if not specified therein then by delivering an original signed, written statement of revocation to the Association headquarters. Payroll Deductions. Deductions from the regular salary will be the applicable taxes in accordance with the employee's claim for exemption and retirement. Payroll Deductions. The A. Upon appropriate written authorization from the bargaining unit member, the Board shall deduct from the salary of such bargaining unit member and make appropriate remittance for any programs not fully paid by the Board, credit union and any other plans or programs as provided in this Agreement.
B. Should the Board consider a new annuity company in accordance with Board Policy, it will seek recommendations from the Association through its President.
C. Upon appropriate written authorization from the bargaining unit member, the Board shall deposit the bargaining unit member's bi-weekly paychecks into the account designated by the bargaining unit member and held with any financial institution participating in direct deposit.
D. This Article shall become effective on August 1 of the year the Association notifies the Superintendent, as the Board’s designee, of its affiliates have the exclusive right of automatic intent to implement payroll deduction of Association dues.
E. The Board agrees to deduct membership dues for the Association from a bargaining unit member’s wages upon submission of a voluntary written authorization that is in compliance with the Payment of Wages and Fringe Benefits Act from the bargaining unit employee to the Superintendent or their designee.
1. If the bargaining unit employee provides written notice to the Superintendent or designee that they are nullifying their authorization for dues deductions, the Board shall have the right to immediately suspend collection of the membership dues for that specific employee.

The SEA agrees to indemnify and save the SPS harmless against any expense liability which may arise by reason on any action taken by the SPS to comply with the provisions of this Article IX,D, including reimbursement for any legal fees or expenses incurred should it choose in connection therewith. Payroll Deductions. 20.01 It is agreed that payroll deductions will be made for dues to the Tonawanda Education Association as teacher individually and voluntarily authorized such payroll deductions, and such total amount of money deducted will be transmitted promptly to the Treasurer of the Tonawanda Education Association for the professional dues.
20.02 The total annual membership dues for the designated professional association, as authorized by the individual concerned, shall be deducted in equal installments.
20.03 No later than two (2) weeks prior to the first scheduled payroll period, the Association shall provide the payroll department with a list, by school, and the original signed dues authorization cards of those teachers who have voluntarily authorized dues deduction for the Association named.
20.04 An authorization on file with the District shall be honored until and unless it has been revoked or amended by written notice received by both the Association and its affiliates have the exclusive right Superintendent. The amount of automatic dues deducted per pay period for each employee shall be uniform. New deduction authorizations must be filed not later than two (2) weeks prior to a scheduled deduction period.

Payroll Deductions. 16.1 Annually, on or before October 1, the Association shall submit to the Superintendent’s office a list of bargaining unit members for whom Association membership dues or Association representation fees are to be deducted from payroll. Each employee who, on the effective date of this Agreement, is a member of the Association, and each employee who becomes a member after that date shall continue membership during the duration of this Agreement; provided, however, that a teacher may, in writing withdraw from membership in the Association within 15 calendar days of each yearly anniversary date of this Agreement. A. The Association shall submit the automatic payroll authorization to the district payroll officer for processing. A table of prorated annual dues, assessmentsstate, and fees shall be supplied national dues owed as well as the teacher’s right to appeal the District Office by the Association to determine monthly dues deductionsrepresentation fee amount.
B. The automatic payroll authorization form shall clearly state that it is understood by the employee signing the authorization that continuation of dues deduction until the end of the dues period on August 31 of each year is a binding condition for automatic payroll deduction.
C. Members of the Association may sign a separate voluntary membership form and dues deduction authorization for WEA-PAC and NEA-PAC. The District will deduct these dues in the same manner described above.
D. The Association agrees to defend and hold the District harmless in the event any employee should bring legal action against the District for compliance with the dues deduction provisions contained in this agreement. The Association, at its expense, will provide such defense. The District shall cover any expense incurred should it choose to employ additional legal counsel.

Payroll Deductions. The Association and its affiliates have the exclusive right of automatic payroll deduction of membership duesPayroll deductions will be made from regular warrants according to governing laws (retirement, assessmentsOASI, federal income tax), and fees as specified in this Agreement. Deductions will also be made, when requested by the individual employee, for certificated employees who voluntarily join those programs recommended by the Association, and authorized by the Board; for example, Committee for the Support of Good Schools, WEA-PAC or United Way.
1. The On or before August 25 of each school year the Association agrees shall give written notice to reimburse any teacher from whose pay the Board of the dollar amount of dues and assessments were deductedof the Association including the National Education Association and the Washington Education Association, those sums which dues and assessments are to be deducted in excess the coming school year under payroll deduction. The total for these deductions shall not be subject to change during the school year.
2. The deductions authorized above shall be made in twelve (12) equal amounts from each paycheck beginning the pay period in September through the pay period in August in each year. Teachers who commence employment after September or terminate employment before June shall have their deductions prorated at one-tenth (1/10th) of the total amount for each month the teacher is employed. The Board agrees to promptly remit directly to the Washington Education Association all monies so deducted, accompanied by a list of teachers from whom the deductions have been made. The Board shall notify the Association of any changes in said list due to teachers entering or leaving the Association at that timeemploy of the District as soon as the information is available.
3. Within ten (10) days of the commencement of employment, provided teachers may sign and deliver to the Association or its affiliate actually received the excess amount. All bargaining unit members may voluntarily join the AssociationBoard a Membership Enrollment Form, however no bargaining unit member which form shall be required to do so. Employees opting to join the Association will sign a membership form (Appendix B) authorizing authorize deduction of membership dues and other assessments required as specified by the Association. Such authorization shall continue in effect from year to year unless a request of revocation is submitted to the Board and the Association, signed by the teacher, and received between August 1 and September 15, preceding the designated school year for membershipwhich revocation is to take effect. The DistrictEach month during the school year, upon receipt the Association agrees to provide the Board with the names of authorization from an employee, will deduct from the employee’s salary each pay period the dues amount set by those teachers who have joined the Association and provided paid their dues and assessments by means other than through payroll deduction.
4. The District agrees upon employee request to make payroll deduction payments to the District Payroll Office. Deductions for employees submitting authorization after the commencement of the school year shall commence in the first possible pay period following such authorization. The district will transmit all dues deduction funds to the account or entity specified by the Association on a monthly basis. Authorizations in effect prior to July 1credit unions: Washington State Teachers Credit Union, 2018 Spokane Teachers Credit Union, Cheney Public Employees Federal Credit Union, and authorizations provided by employees hired after that date will be on a continuing basis from year to year, unless withdrawn in writing to the Washington Education Association through the established process: All Membership “drop” requests must be processed through the WEA office before payroll may cease deduction of dues. Members who wish to cease membership dues and drop their membership must make inquiries to the WEA directly. The Board assumes no obligation, financial or otherwise, arising out of the provisions of this section, and the Association agrees to defend and/or educator covered by this Agreement shall indemnify and hold the District Board harmless in for any and all claims, grievances, awards, suits, attachments, or other proceedings arising out of, or by reason of, any action taken by the event Board for the purpose of complying with any employee should bring legal action against of the District for compliance with the dues deduction provisions contained in of this agreement. Payroll Deductions. The Upon receipt of the substitute teacher's written request, the District will deduct the following from salary: Association member dues , premiums for Board approved medical insurance, tax sheltered annuities, and its affiliates have contributions to the exclusive right of automatic payroll deduction of United Way.
1. A substitute teacher may request in writing that his/her regular Association membership dues, assessmentsincluding any OEA or NEA dues, be deducted from his/her salary. The first monthly deduction shall be made on the pay date following the District's receipt of authorization if received before the district’s payroll cutoff deadline and fees if not then on the following pay date. Such authorization shall continue in effect year to year until revoked by email or letter delivered to the district’s Human Resources office and the Association on or before October 15 of each year.. The amount deducted shall be one-tenth (1/10) of the annual dues. Deductions will be made only for certificated employees who voluntarily join the months the substitute teacher actually works. A member’s cancellation of any dues deduction authorization received by the district on or before October 15 shall be effective October of the same year. Otherwise, the cancellation shall be effective October of the following year. The District and the Association shall each provide the other with a copy of the unit member’s authorization of membership dues deduction or cancellation of the dues deduction authorization within five (5) business days of receipt. The District will maintain a member’s authorization and/or cancelation of the same in the member’s personnel file.
2. The amount of Association dues collected shall be remitted to the Association each month at no cost to the substitute or the Association. The District shall provide the Association agrees to reimburse with the names of substitute teachers for whom the District has deducted dues.
3. The Association assumes responsibility for, and shall defend, indemnify and hold the District, its employees, agents and board members harmless from any teacher and all claims, causes of action, administrative complaints, lawsuits, orders, or judgments resulting from whose pay dues and assessments were deducted, those sums in excess of the total amount due or elated to the Association at that time, provided deduction of union dues and/or contributions deducted from an employee’s salary and payment of such dues and/or contributions to the Association or its affiliate actually received affiliates. The Association’s obligations are contingent upon the excess amountDistrict: (1) giving the Association reasonable notice, in writing, of any claim; and (2) fully cooperating with the Association and counsel selected by the Association in the defense of the claim.
