Common use of Penalties/liquidated Damages Clause in Contracts

Penalties/liquidated Damages. The Contractor shall disburse salary to its deployed manpower as per Central Govt. minimum wages Act latest by 15th of every month, failing which penalty equivalent to one-day salary (Basic + DA) per delayed day shall be credited by the contractor into the account of the respective employees whose salary has been delayed, apart from his regular remuneration which the contractor is payable to him. Proof of the same shall be submitted to the SBI along with the bills of the next month. If such scenario continues for a period of 3 continuous months then the contract shall be liable to be terminated. The SBI will have the power to appoint any other agency for the manpower services at the risk and cost of the Contractor. • The Contractor has to maintain adequate number of manpower as per this contract and also arrange a pool of standby manpower/supervisor. If the required number of manpower/supervisors are less than specified number as mentioned in the contract, a penalty of Rs.1000/- per absentee per day shall be deducted from the bill(s). • In case of breach of any conditions of the contract and for all types of losses caused including excess cost due to hiring manpower services in the event of Contractor failing to provide requisitioned number of manpower, the SBI shall make deductions at double the rate of hiring rate on pro-rata basis from the bills preferred by the Contractor or that may become due to the Contractor under this or any other contract or from the security deposit or may be demanded from the Contractor to be paid within seven days to the credit of the SBI. • An amount of Rs. 2500/- will be levied as liquidated damages per day per floor for any building from the Contractor whenever and wherever if found that the work is not up to the mark. If the Contractor fails to perform as per the satisfaction of the SBI within 15 days, liquidated damages clause as incorporated in the tender document of the Contractor by SBI will be invoked. • Under any circumstances the collected wastes should not be burnt or dumped inside the campus. This includes the dumping of the waste in open near the stairs of the premises. Strictly, dustbins must be used for dumping of the waste. Such dustbins which are out in open near the stairs or any part of the premises, should be emptied immediately once they are found to be full and waste should be left to be dumped near that dustbin. In case of any such observation by the SBI, the Contractor shall be penalized up to 5% of the monthly Bill amount which will deducted from any bills/dues of Contractor.

Wherein the Supplier fails to its deployed manpower make deliveries as per Central Govtsigned contract & purchase order and within the stipulated time frame specified in the Schedule of Requirement, the Contract to the extent of non-delivered portion of supplies shall stand cancelled. ii). minimum wages Act latest by 15th After the cancellation of every month, failing which penalty equivalent to one-day salary (Basic + DA) per delayed day the Contract no supplies shall be credited by accepted and the contractor into amount of Performance Guaranty/Security to the account extent of the respective employees whose salary has been delayed, apart from his regular remuneration which the contractor is payable to him. Proof non–delivered portion of the same supplies shall be submitted to the SBI along with the bills of the next monthforfeited. iii). If such scenario continues for a period the Supplier fails to supply the whole consignment and not able to deliver to consignee’s end, the entire amount of 3 continuous months then the contract shall be liable to be terminated. Performance Guaranty/Security Deposit / Performance Bank Guarantee shall be forfeited to the Government account and Bank guarantee the firm shall be encashedblacklisted minimum for two years for future participation. iv). In case of late delivery of goods beyond the periods specified in the Schedule of Requirements and subsequent purchase order, a penalty @ 0.067% per day of the cost of late delivered supply shall be imposed upon the Supplier. vi). The procuring Agency shall disqualify a bidder if it finds, at any such observation time, that the information submitted by him concerning his qualification as bidder was false and materially inaccurate or incomplete. vii). If the lowest bid is rejected due to incompliance of terms and conditions laid down in the bidding documents and contract, the Procuring Agency may proceed (if feasible) on the same tender with next lowest bid. i). If the Bid is accepted, bidder will have to deliver the goods to The Children’s Hospital within stipulated time period mentioned in the supply order during the working hours. ii). Partial supply will not be acceptable. iii). If stores rejected by the SBIinspection committee, it will be replaced by the bidder within a week, otherwise, the Contractor shall rejected items will be penalized up to 5% forfeited in favor of the monthly Bill amount which hospital and bill of the remaining items, if present in the purchase order, will deducted from any bills/dues not be forwarded. iv). The bidder will submit three copies of Contractorbill against supplies at the time of delivery to the office of the Xxxx / Medical Director, duly supported by three photocopies of purchase order, invoice, advance acceptance, award letter and delivery challan.
