Percentage Limits. Upon date of implementation (March 16, 2016), the number of part- time Employees in the system within a classification covered by this agreement shall not exceed 13%. Those stations where flight activity exceeds 12 departures per day may not exceed 18% of any classification as part-time agents. In stations where flight activity does not exceed twelve (12) departures per day, 100% of Employees may be part-time and are excluded from the maximum percentages for the system. However, in stations where flight activity does not exceed twelve (12) departures and are grandfathered per Article 2.F.2 of this agreement, the Company may go up to 100% part-time Employees through attrition only and are included in the maximum percentages for the system. On the one-year anniversary of the date of implementation (March 16, 2017), the following limits apply regarding stations with flight activity that exceeds 12 departures per day: • Maximum system percentage will not exceed 15% • Stations with flight activity greater than 12 departures per day will have a maximum of 20% part-time Employees for each station’s individual classification. On the three-year anniversary of the date of implementation (March 16, 2019), the following limits apply regarding stations with flight activity that exceeds 12 departures per day: • Maximum system percentage will not exceed 17% • Stations with flight activity greater than 12 departures per day will have a maximum of 22% part-time Employees for each station’s individual classification. In calculating percentages, the Company will round to the nearest whole number.

Percentage Limits. No share of Common Stock will be sold or ----------------- otherwise transferred (with or without consideration) to any individual if such transfer would result in the ownership by such individual in combination with four or fewer individuals (within the meaning of Section 542(a)(2) of the Internal Revenue Code of 1986 (the "Code")) of more than fifty percent of the aggregate value of all shares of all classes of capital stock of the Corporation (the "Percentage Ownership Limit"). --------------------------
Percentage Limits. The number of part-time Employees in the system within a classification covered by this Agreement shall not exceed ten percent (10%) of any classification. In addition, stations employing twenty (20) or fewer Employees covered by this Agreement may not schedule more than twenty percent (20%) of any classification as part-time Employees. Those stations employing more than twenty (20) Employees may not schedule more than fifteen percent (15%) of any classification as part-time agents. In calculating percentages, the Company shall round to the nearest whole number, but, in any event, each classification within a station shall be entitled to at least one (1) part-time Employee.

  • Usage Limits Services and Content are subject to usage limits, including, for example, the quantities specified in Order Forms and Documentation. Unless otherwise specified, (a) a quantity in an Order Form refers to Users, and the Service or Content may not be accessed by more than that number of Users, (b) a User’s password may not be shared with any other individual, and (c) except as set forth in an Order Form, a User identification may only be reassigned to a new individual replacing one who will no longer use the Service or Content. If You exceed a contractual usage limit, We may work with You to seek to reduce Your usage so that it conforms to that limit. If, notwithstanding Our efforts, You are unable or unwilling to abide by a contractual usage limit, You will execute an Order Form for additional quantities of the applicable Services or Content promptly upon Our request, and/or pay any invoice for excess usage in accordance with Section 6.2 (Invoicing and Payment).

  • PERCENTAGE GOAL The goal for Historically Underutilized Business (HUB) participation in the work to be performed under this contract is 23.7 % of the contract amount.

  • Reallocation to a Class with a Lower Salary Range Maximum 1. If the employee meets the skills and abilities requirements of the position and chooses to remain in the reallocated position, the employee retains the existing appointment status and has the right to be placed on the Employer’s internal layoff list for the classification occupied prior to the reallocation. 2. If the employee chooses to vacate the position or does not meet the skills and abilities requirements of the position, the layoff procedure specified in Article 31 of this Agreement applies.

  • Annual Percentage Rate Each Receivable has an APR of not more than 25.00%.

  • Minimum Amounts and Maximum Number of Tranches All borrowings, prepayments, conversions and continuations of Loans hereunder and all selections of Interest Periods hereunder shall be in such amounts and be made pursuant to such elections so that, after giving effect thereto, the aggregate principal amount of the Loans comprising each Eurodollar Tranche shall be equal to $10,000,000 or a whole multiple of $1,000,000 in excess thereof.   • Applicable Expense Limit To the extent that the ordinary operating expenses incurred by the Fund in any fiscal year, including but not limited to investment advisory fees of the Advisor, but excluding interest, taxes, brokerage commissions, other investment-related costs and extraordinary expenses, such as litigation and other expenses not incurred in the ordinary course of the Fund’s business (“Fund Operating Expenses”), exceed the Operating Expense Limit, as defined in Section 1.2 below, such excess amount (the “Excess Amount”) shall be the liability of the Advisor to the extent set forth in this Agreement.

  • Coverage Limits By requiring insurance, the State of Washington and DSHS do not represent that the coverage and limits required in this Contract will be adequate to protect the Contractor. Such coverage and limits shall not limit the Contractor’s liability in excess of the required coverage and limits, and shall not limit the Contractor’s liability under the indemnities and reimbursements granted to the State and DSHS in this Contract.

  • Percentage in Lieu The eight and one-half percent (8.5%) premium is given in lieu of benefits under Articles 12 (except 12.04), 14, and 17.
