Promotion/Transfer. For the purpose of this Section, promotion and transfer is defined in Article 15 section 1. All voluntary transfers and promotional appointments shall be tentative and subject to a trial period of six (6) full calendar months of actual full-time service. During this trial period, in its discretion the City may reclassify, reassign or reallocate the promoted or transferred employee, or return the employee to their previously held position, and such action shall not be subject to the grievance procedure. During the initial six (6) week period following the transfer or promotion, the employee reserves the right to resume their previous position provided the position remains authorized by the City. If the position has been filled during the trial period, the provision of Article 12 - Seniority shall apply. Any interruption of service during the trial period shall not be counted as part of such period.

Promotion/Transfer. The District shall agree to post on employee bulletin boards, maintained for such purpose, all permanent job openings in positions covered by this Agreement for a period of seven (7) working days prior to a permanent filling of these vacancies. Employees promoted shall be granted a four (4) week trial period to determine his/her ability to perform the jobs, and his/her desire to remain on the job. During the four (4) week trial period, the employee shall have the opportunity to revert to his/her former position if vacant, otherwise, a position in his/her former classification assigned by the designated supervisor. If the employee is unsatisfactory in the new position, notice and reasons shall be submitted in writing by the supervisor to the Personnel Director or other Superintendent's designee with a copy to the employee. The employee may then be reassigned to his/her former classification and to his/her former seniority status. During the trial period, employees will receive the rate of the job he/she is performing. (All seniority accumulation to be suspended during any trial employment period within a different bargaining group at Waverly Schools.)
Promotion/Transfer. An employee promoted within the promotional line, or transferred from one job classification to another, will not suffer a decrease in salary. He/She will remain at the probationary rate of the new position or at his/her old rate (whichever is higher) for the civil service probationary period of six (6) months. In the event of a promotion within the promotional line, the employee will receive the negotiated rate immediately. However, when an employee takes a voluntary transfer to a lower paid classification, he/she shall receive the lower rate.
Promotion/Transfer i) Appointment to a Workshop position shall be open to any member of Stadler Staff and shall be on the basis of suitability only, subject to meeting the medical, competence and aptitude selection criteria. All else being equal, seniority will be the determining factor. ii) Vacancies will be advertised on a companywide vacancy list and will be open to all staff. Applications may also be sought from external sources at any time. Whilst internal applicants will be given priority consideration, selection will be based on suitability and ability to meet competence requirements and Railway Group Standards for medical and aptitude assessment selection criteria. iii) On appointment, successful applicants will be placed into their new post and paid the appropriate rate of pay as determined by their competency (see section 5). Where applicable, progression to the higher salary will be dependent upon being assessed as fully competent in all duties associated with the new post. iv) The competence of the person in their new post shall be monitored during the first 6 months by the Production Manager or Technical Trainers and be subject to review and assessment during this period. If, during this period, the person fails to meet the competency criteria and standards required of their new post, then they shall be removed from the post and put on notice. Every attempt will be made to redeploy them into a suitable position within Stadler(typically, for an internal appointment, in the grade in which they previously worked) v) The date of seniority in the grade for redundancy purposes shall be the date that the member of staff was first appointed to that grade. Where more than one employee in the same grade has the same seniority date, then the date the employee first entered the employment of Stadler or its predecessors shall be the deciding factor. In the event of this date being the same the person with the latest date of birth will be displaced. vi) All vacancies will be filled at Management’s discretion. However, where it is management’s intention not to fill a vacancy within 3 months of it occurring, the Company Council representatives will be advised. vii) Fleet Maintenance Staff will be allowed to transfer to another Stadler depot at the discretion of management. Promotion/Transfer. A. An employee who meets the minimum qualifications for a vacant position shall be given the opportunity to apply for and be considered for a vacancy. "Qualifications" shall mean education, training, experience in the Xxxxxx Public Schools, written evaluations as provided in Appendix A (Employee Evaluation Form), physical and mental ability. "Ability" is defined as the capacity to do the required tasks without additional training of more than one week’s duration where the qualifications cannot be determined through testing or assessment as determined by the employer. If they do not return to the bargaining unit during this period, their seniority will be lost.

Promotion/Transfer. In cases of promotion and transfer, employees shall have first preference in order of their seniority, provided that the employee has the ability and fitness to perform the required work. In the event a permanent vacancy occurs outside the department in which a fully qualified employee in the bargaining unit is working, such permanent vacancy will be made known to all such employees and the Union prior to hiring a new employee to fill such vacancy. All current employees will be provided an opportunity to receive the training, classes or other necessary instruction to secure any current job qualification, on paid time. If employees are not provided an opportunity and they seek to transfer within their own job classification, they will be grandfathered and not required to satisfy any prerequisite that was not similarly required at their time of initial hire in order to be granted an interview or awarded the position. The most senior fully qualified employee desiring to fill such vacancy will be transferred on the basis of county-wide seniority. Any interviews, testing or other prerequisites necessary to be considered for promotion or transfer will be conducted on paid time not to exceed two (2) hours unless additional time is required by the employer. When filling the position of Xxxxxxx, preference shall be given to eligible bidders within the respective department or institution in which the position exists.

When a position becomes vacant that the Employer intends to fill, it shall first be offered to applicants from among bargaining unit employees in the same job title and department as a shift or location transfer and them shall be electronically posted and employees will be given preference in order of seniority in the following order: a. To qualified employees in a different job title in the same department; b. then to qualified employees in bargaining units under Offices Under the President;‌ c. then to qualified employees in other SEIU Local 73 bargaining units; d. and finally, to outside applicants. An employee requesting a later shift or location transfer within the same department shall not be subject to an interview. The requested lateral transfer or location transfer will be awarded in order of seniority, provided that the employee has the ability and qualifications to perform the required work.
