Performance of Existing Products. The Company's currently licensed and marketed commercially available products, including any customized products, perform in all material respects with the functions described in any currently applicable agreed upon specifications or end user documentation provided to Parent or to customers or potential customers of the Company and in accordance with the Company's contractual obligations to the Company's customers. The Company has not been notified, either verbally or in writing, that such products do not perform as set forth above.

Performance of Existing Products. Seller’s currently licensed and marketed commercially available products related to the Business, including any customized products, perform in all material respects in accordance with the functions described in any agreed written specifications or end user documentation provided to customers or potential customers of Seller and in accordance with Seller’s contractual obligations to Seller’s customers. Seller has not been notified, either verbally or in writing, that such products do not perform as set forth above.
Performance of Existing Products. The Company’s existing and currently manufactured and marketed products perform, free of material defects, the functions described in any agreed specifications or end user documentation, press releases or other information provided to Buyer or to customers or potential customers of the Company on which such customers or potential customers relied or would reasonably be expected to rely upon when licensing or otherwise acquiring such products and the Company has not been notified, either in writing or, to the Knowledge of the Company, verbally, that such products do not perform as set forth above. To the extent that the Company’s products have not been launched, the Company has fully disclosed to Buyer in writing all currently known technical problems or concerns associated with such products that affect the performance of the Company’s products.

The Selling Parties have not been notified, either verbally or in writing, that such products do not perform as set forth above. To the extent that the Selling Parties’ products listed on Schedule 4.12(n) have not been launched, to the Seller’s knowledge, the Selling Parties have used commercially reasonable efforts to disclose to Purchaser in writing all currently known technical problems associated with such products that affect the performance of such products.

Performance of Existing Products. Section 2.13(m) of the Seller Disclosure Schedule sets forth all unresolved support calls and all material unresolved documented bugs and sightings as of the date of this Agreement and any other bugs or errors in any Seller Product of which Seller is aware, and the Seller Products perform substantially in accordance with the functional specifications and documentation provided to customers of Seller and its Subsidiaries.
Performance of Existing Products. Credence’s existing and currently manufactured, supported and marketed Products are listed and described in Section 3.10(j) of the Credence Disclosure Schedule and, to the knowledge of Credence, perform in accordance with the functions described in any specifications or end user documentation, press releases, or other information provided by or at the request of Credence to customers or potential customers of Credence on which such customers or potential customers relied or reasonably could be expected to rely upon when licensing or otherwise acquiring such Products. Credence is not aware of any bugs or defects in existing and currently manufactured, supported and marketed Products that could reasonably be expected to have a material adverse effect on the Business as conducted and as proposed to be conducted.
