Performance of Existing Products. The Company’s currently licensed and marketed commercially available products, including any customized products, perform in all material respects in accordance with the functions described in any agreed written specifications or end user documentation provided to Parent or to customers or potential customers of the Company and in accordance with the Company’s contractual obligations to its customers. The Company has not been notified, either verbally or in writing, that such products do not perform as set forth above.

Performance of Existing Products. Seller’s currently licensed and marketed commercially available products related to the Business, including any customized products, perform in all material respects in accordance with the functions described in any agreed written specifications or end user documentation provided to customers or potential customers of Seller and in accordance with Seller’s contractual obligations to Seller’s customers. Performance of Existing Products. Credence’s existing and currently manufactured, supported and marketed Products are listed and described in Section 3.10(j) of the Credence Disclosure Schedule and, to the knowledge of Credence, perform in accordance with the functions described in any specifications or end user documentation, press releases, or other information provided by or at the request of Credence to customers or potential customers of Credence on which such customers or potential customers relied or reasonably could be expected to rely upon when licensing or otherwise acquiring such Products. Credence is not aware of any bugs or defects in existing and currently manufactured, supported and marketed Products that could reasonably be expected to have a material adverse effect on the Business as conducted and as proposed to be conducted.
Performance of Existing Products. The Selling Parties’ currently licensed and marketed commercially available products, including any customized products, that incorporate any of the Transferred Technology perform in all material respects in accordance with the functions described in any agreed written specifications or end user documentation provided to Purchaser or to customers or potential customers of the Selling Parties and in accordance with the Selling Parties’ contractual obligations to the Selling Parties’ customers. The Selling Parties have not been notified, either verbally or in writing, that such products do not perform as set forth above. To the extent that the Selling Parties’ products listed on Schedule 4.12(n) have not been launched, to the Seller’s knowledge, the Selling Parties have used commercially reasonable efforts to disclose to Purchaser in writing all currently known technical problems associated with such products that affect the performance of such products.
