Permitted Encroachments. 3.11.1 Every part of any required setback or separation distance shall be open and unobstructed by any structure except to permit uses or encroachments subject to the following provisions:
(a) Uncovered patios, walkways, wheelchair ramps, lifting devices or steps may be located in any yard;
(b) The usual projections of xxxxx, cornices, xxxxx, gutters, chimneys, pilasters, canopies or other architectural features may be erected or maintained in any yard, provided that no such structure or feature shall project more than 0.6 metres (2 feet) into any required yard;
(c) Window bays and solar collectors may be permitted to project not more than 0.9 metres (3 feet) from the main wall into a required front, rear or flankage yard;
(d) Exterior staircases, balconies, porches, verandas and sundecks shall not be permitted to project into any required yard;
(e) The provisions of this Section shall not restrict the location of ornamental planting or landscaping in any yard.
Permitted Encroachments. City will allow Licensee to maintain the following existing encroachments (together, “Permitted Encroachments”) installed by Licensee within the Pathway Area in their current locations on the Pathway Area:
(a) three (3) wooden trail signs;
(b) five (5) wooden benches;
(c) three (3) garbage cans;
(d) two (2) bicycle safety signs;
(e) one (1) water fountain;
(f) one (1) backflow preventor; and
(g) one (1) concrete bench.
Permitted Encroachments. Any and all improvements required by the Public Development District established by Ordinance No. 334 adopted by the City, as such ordinance may be amended from time to time, shall be permitted encroachments into the Easement Tract.
