Personal Illness or Disability - Illness, Injury, or Death in the Immediate Family. 1. At the beginning of the school year each employee shall be credited with ten (10) days of leave, the unused portion of which shall accumulate from year to year to a maximum of sixty (60) days. The employee may use all or any portion of his/her leave for an absence resulting from an illness, injury or disability of or to the employee, including pregnancy, termination of pregnancy and recovery therefrom, which prevents the employee from fulfilling his/her duties at school. Such absence to include attendance at clinics for medical or dental diagnosis or treatment, resulting from such illness, at a physician's or dentist's direction. The teacher shall return to work as soon as physically able as determined by his/her physician. At the time sick leave is requested, the teacher shall inform the building administrator or his/her designee in general terms the reasons for the sick leave. The teacher shall be reimbursed on or before July 1, for all unused sick leave from the previous school year, in excess of the maximum days, at the rate of $25.00 per day. Further, that the employee may use all or any portion of his/her leave for illness, injury or death in the immediate family. The immediate family shall include the father, mother, brother, sister, son, daughter, husband, wife, grandmother, grandfather, grandson, granddaughter, and in-laws of these classifications, uncle, aunt, nephew, xxxxx, step-children, and other dependent persons. Unless the exact relationship is indicated in writing to the principal, the absence will be deductible from salary. In the event of an absence of over three (3) days, the administration may request verification of illness from a physician; further provided, that in the event of an absence of over five (5) days the employee shall provide to the administration a letter from said employee's personal physician clearly stating the date the absence is to begin and the anticipated date that the employee will be able to return to work. The Board retains the right to have the employee examined by a physician of mutual choice if a disagreement arises over the recommendations as made by the employee's personal physician. In the event this occurs, the Board will pay for the examination. Once the beginning date and the anticipated ending date of the absence have been established, the employee may use accumulated sick leave for said absence. In the event the employee desires to request a leave of absence prior to the established beginning date or after the established ending date of said absence, the leave will be considered as Extended Leave - Health Reasons and will be without pay. Two days of personal leave may be converted and used as two days of sick leave. Any teacher wanting to convert one or two days of personal leave to one or two days of sick leave, shall make a written request to the Superintendent, and said written request shall set forth the specific grounds of the request. The Superintendent shall have full and complete discretion in determining whether or not to grant the conversion. The Superintendent’s decision on the conversion shall be final. Nothing contained herein, shall increase the current maximum accumulated sick leave of sixty (60) days.

On the job injuries resulting from student or patron assaults: In the event a certified employee is absent from work as the result of personal injury by reason of an assault by a student or patron while performing job related duties within the scope of the certified employee’s employment with the District, which injury is covered by the District’s workers compensation insurance carrier, such absence will not be charged against the certified employee’s temporary leave days. The certified employee, for each such day of absence, will be paid the difference between the amount the certified employee receives from the District’s workers compensation insurance carrier if any and the certified employee’s daily take home pay. (Work comp payments are not taxed.) In the event the certified employee is required to be absent from work by a doctor’s orders, in order to receive medical treatment provided by the District’s workers compensation carrier for a job-related assault by a student or patron, but is not at the time of the absence receiving temporary total disability benefits from the District’s workers compensation insurance carrier, and is not there after entitled to receive such benefits for the day of absence, the absence will not be charged against the certified employee’s available temporary leave days and the certified employee shall continue to receive his/her contracted salary during such absence. Proper verification of such medical orders and treatment must be provided by the certified employee. In the event, the need for medical leave extends beyond 20 days, and Xxxxxxx’x Compensation compensates the employee for the first 7 days of absence, the employee may choose to reimburse the District for the amount equal to their take home pay for those 7 days, or use 7 days of earned leave for those days.
