Common use of Planning and Construction Phase Clause in Contracts

Planning and Construction Phase. The Parties understand and agree that approval of the Project is generally under the jurisdiction of the PSCW and that the Project’s preliminary site plans must be approved by the PSCW for substantive site design changes, absent PSCW’s request for such changes, unless there is a change in law which authorizes counties and local units of government to enforce laws and ordinances which they are prevented from enforcing by state law at the time this Agreement is executed.
