Common use of Policy Endorsements Clause in Contracts

Policy Endorsements. (a) The commercial/general liability insurance shall contain the following endorsement items: (i) BPDB, its directors, officers and employees shall be additional insured under such policies with respect to claims arising out of or in connection with this Agreement; (ii) The insurance shall be primary with respect to the interest of BPDB, its directors, officers, and employees and any other insurance maintained by them is excess and not contributory with such policies; (iii) The insurance shall contain a cross liability clause; (iv) The insurer shall waive all rights of subrogation against BPDB, its officers, directors and employees; and (v) Notwithstanding any provision of the policy, the policy may not be cancelled, non- renewed or materially changed by the insurer without giving thirty (30) Days, except in the case of non-payment, in which case it will be ten (10) Days, prior written notice to BPDB. All other terms and conditions of the policy shall remain unchanged.
