POSSESSION AND SURRENDER OF EQUIPMENT. Lessee shall be entitled to possession of the Equipment on the first day of the Lease Term. At the expiration of the Lease Term, Lessee shall surrender the Equipment to Lessor by delivering the Equipment to Lessor or Lessor’s agent in good condition and working order, ordinary wear and tear excepted, as it was at the commencement of the Agreement.

At the expiration of the Rental Term, Renter shall surrender the Equipment to Company by delivering the Equipment to Company or Company’s agent in good condition and working order, ordinary wear and tear excepted, as it was at the commencement of the Agreement. Renter may surrender the Equipment to Company prior to the end of the Rental Term, however Company's acceptance of such surrender shall not entitle the Renter to any refund or credit.

At the expiration of the Lease Term, you shall surrender the Equipment to SUNSET PACIFIC TRANSPORTATION, Inc. by delivering the Equipment to SUNSET PACIFIC TRANSPORTATION, Inc or SUNSET PACIFIC TRANSPORTATION, Inc’s agent in good condition and working order, ordinary wear and tear excepted, as it was at the commencement of the Agreement. Lessee acknowledges that title to the Equipment will at all times be vested in SUNSET PACIFIC TRANSPORTATION, and no right, title, or interest in the Equipment will pass to Lessee other than, conditioned upon Lessee’s compliance with the Lease, the right to possess and use the Equipment as provided in the Lease. Lessee agrees not to sell, assign, sublet, pledge, or otherwise encumber any interest in the Lease or the Equipment and agrees to keep the same free from any lien, encumbrance, right of distraint or any other claim that may be asserted by any third party. Lessee will immediately notify SUNSET PACIFIC TRANSPORTATION in writing of any tax or other liens attaching to the Equipment. SUNSET PACIFIC TRANSPORTATION may require plates or markings to be affixed to or placed on the Equipment indicating SUNSET PACIFIC TRANSPORTATION’s interest. SUNSET PACIFIC TRANSPORTATION and Lessee hereby confirm their intent that the Equipment always remain and be deemed personal property even though the Equipment may hereafter become attached or affixed to realty. Lessee will obtain all such waivers as SUNSET PACIFIC TRANSPORTATION may reasonably require to acknowledge SUNSET PACIFIC TRANSPORTATION’s title to and assure SUNSET PACIFIC TRANSPORTATION’s right to remove the Equipment, including any landlord and mortgagee waivers. In the event a court of competent jurisdiction determines that the Lease represents a conditional sale or financing arrangement, Lessee grants SUNSET PACIFIC TRANSPORTATION a continuing first priority security interest in the Equipment and all proceeds thereof to secure Lessee’s obligations under the Lease.
POSSESSION AND SURRENDER OF EQUIPMENT. Lessee shall be entitled to possession of the Equipment on the first day of the Lease Term. At the expiration of the Lease Term, Lessee shall surrender the Equipment to Lessor by delivering the Equipment to Lessor or Lessor's agent in good condition and working order, ordinary wear and tear excepted, as it was at the commencement of the Agreement. Delivery of the Equipment shall be to a location within 75 miles of Columbia, South Carolina, mutually agreed upon by the Parties. If the Parties agree to deliver the Equipment to a location beyond a 75 mile radius of Columbia, Lessee may seek recovery from Lessor of the cost of delivery of the Equipment beyond the 75 mile radius.
POSSESSION AND SURRENDER OF EQUIPMENT. Possession of the Equipment shall be transferred to End User on the first day of the Initial Rental Term. At the expiration of the Rental Term, End User shall surrender the Equipment to Zebra (or to Authorized Reseller, as instructed by Zebra) in good condition and working order, ordinary wear and tear excepted, as it was at the commencement of the Initial Rental Term.
POSSESSION AND SURRENDER OF EQUIPMENT. Licensee shall exercise prudent care in the use and maintenance of the Equipment and shall maintain it in good working order. The Equipment shall be returned to FIU in the same condition as when it was leased to Licensee, ordinary wear and tear accepted. Licensee will be responsible for the cost of any repairs to the Equipment as a result of damage occurring during the Term hereof or arising out of or resulting from the rights granted to Licensee under this Agreement. In the event the Equipment is lost or damaged beyond repair, Licensee shall pay to FIU the replacement cost of the Equipment; in addition, the obligations of this Agreement shall continue in full force and effect through the Term.
POSSESSION AND SURRENDER OF EQUIPMENT. Lessee shall be entitled to possession of the Equipment on the first day of the Lease Term. At the expiration of the Lease Term, Xxxxxx shall surrender the Equipment to Lessor by handing over the Equipment to Lessor or Lessor’s agent in good condition and working order as it was at the commencement of the Agreement, or minus any security deposit as in section 5 of thisagreement.
POSSESSION AND SURRENDER OF EQUIPMENT. Renter shall be entitled to possession of the Equipment on the first day of the Rental Term. At the expiration of the Rental Term, Renter shall surrender the Equipment to KMS by delivering the Equipment to KMS or an agent of agent in good condition and working order, ordinary wear and tear excepted, as it was at the commencement of the Agreement. Renter may surrender the Equipment to KMS prior to the end of the Rental Term, however KMS’ acceptance of such surrender shall not entitle the Renter to any refund or credit.
POSSESSION AND SURRENDER OF EQUIPMENT. Rentee shall be entitled to possession of the Equipment on the first day of the Rent Term. At the expiration of the Rent Term, Rentee shall surrender the Equipment to Rentor by delivering the Equipment to Rentor or Rentor’s agent in good condition and working order, ordinary wear and tear accepted, as it was at the commencement of the Agreement. After 90 days, if the system is not returned, the full amount of the system less the rental fee and security deposit, will be charged to the card on file as authorized.
