Powers and Duties of Plan Administrator. The Plan Administrator shall have the authority to control and manage the operation and administration of the Plan, and shall be granted the discretion to administer, construe and interpret the provisions of the Plan, including but not limited to the determination of the rights of employees with respect to eligibility for benefits, establishment of accounting methods for the Plan, and the establishment of rules and any forms necessary for the proper and efficient administration of the Plan.

Powers and Duties of Plan Administrator. The powers and duties of the Plan Administrator shall include, but not be limited to, the following:
Powers and Duties of Plan Administrator. The Plan Administrator will administer the Plan in accordance with its terms solely in the interest of Participants, Former Participants and their Beneficiaries for the exclusive purpose of providing benefits to such persons and defraying reasonable expenses of administering the Plan and Fund. In administering the Plan, the Plan Administrator will employ a degree of care, skill, prudence and diligence which, under circumstances then prevailing, a prudent man acting in like capacity and familiar with such matters would use in the conduct of an enterprise of like character and with like aims. The Plan Administrator will have all powers necessary to carry out the terms of the Plan. All interpretations of the Plan and questions concerning its administration and application will be determined by the Plan Administrator, and such determinations will be binding on all persons except as otherwise expressly provided herein.
