Common use of Pre-Arbitration Clause in Contracts

Pre-Arbitration. The Human Resources Director or designee and the Union may by mutual agreement utilize mediation for grievances filed under the provisions of this Agreement. The mediation process described in this Section may be invoked only by the two (2) parties identified herein and is expressly an exception to the language contained in Section 3 of this Article. The parameters of the mediation process, where mutual resolution of the grievance or disciplinary appeal sought, are as follows:
