Preliminary Phase. State or Agency shall perform the Services outlined in this Section A during the preliminary right of way phase of the Project as identified below. When Services listed under this Section A are performed by Agency, Agency shall charge the Services as preliminary engineering expenditures.

2. Agency shall make preliminary contacts with property owners.
3. Agency shall gather and prepare data for environmental documents.
4. Agency shall develop access and approach road list.
5. Agency shall help prepare field location and project data as defined in the Project Agreement.

Preliminary Phase. 3.1 In order to create an Event on the Platform, COOP ITALIA prepares:
3.2 COOP ITALIA forwards to selected Suppliers an invitation to the Event itself through the Platform messaging system, thus making available what indicated in par.3.1.
3.3 COOP ITALIA has the right to modify what indicate in par.3.1, including the Platform configuration parameters, informing Suppliers through the Platform messaging system.
3.4 Suppliers acceptance of COOP ITALIA invitation to participate to the Event happens implicitly through the insertion of the information requested for the participation to the Event.
Preliminary Phase. (1) Attend preliminary conferences with the OWNER and, if requested, with the funding agency and other government agencies or interested parties regarding the Project.
(2) Provide for the necessary geotechnical investigation and testing necessary to develop the design.
(3) Provide environmental studies as may be necessary to complete a project.
(4) Provide assistance to the OWNER in providing material requirements and specifications for design, construction and maintenance projects.
(5) Provide assistance to the OWNER in providing pavement design recommendations for the design, construction and maintenance projects.
(6) Provide assistance to the OWNER in providing pavement rehabilitation recommendations for the design, and maintenance projects.
(7) Provide assistance to the OWNER in providing pavement condition studies.
Preliminary Phase. (a) CEU shall commit $22,500,000 (the “CEU Base Capital”) and Trigon shall commit $2,500,000 (the “Trigon Base Capital”), for a total commitment of the Parties of $25,000,000 in the aggregate (the “Committed Capital”), for the acquisition of oil, gas and other hydrocarbon interests, including leases, within the AMI from the date hereof until the Equity Commitment Date (such period being referred to herein as “Phase One”). The interests to be acquired and the terms of each acquisition, including lease terms, shall be proposed by Trigon; provided however, during Phase One no interest within the AMI shall be acquired by Trigon, or any Affiliate of Trigon, or any other party affiliated with Trigon, without the prior consent of CEU. All leases shall provide that they can be assigned to CEU (or a CEU affiliate designated in advance of signing the lease) without the prior consent of the lessor, unless CEU (in its sole discretion) otherwise agrees in writing. No party affiliated with Trigon shall retain any interest or receive any fee or compensation in connection with such acquisitions. CEU shall promptly deliver to Trigon 90% of the Lease Acquisition Costs related to any Phase One Property, and Trigon shall fund the remaining 10% of such Lease Acquisition Costs. In no event shall CEU be required to deliver to Trigon an amount in excess of 90% of the Committed Capital during Phase One. All amounts funded by CEU during Phase One shall be used solely for the purpose of acquiring Phase One Property or for Seismic Projects or Seismic Data in which CEU has elected to participate pursuant to Article IV. In connection with any funding request, Trigon shall provide CEU, at least five (5) Business Days in advance of funding, a detailed statement reflecting the interests acquired or to be acquired with such funds and all Lease Acquisition Costs to be paid with such funds. In no event shall CEU be required to fund its share of any Lease Acquisition Costs more than one (1) Business Day in advance of the acquisition of the applicable Phase One Property. The total amount advanced by CEU during Phase One, whether for Lease Acquisition Costs or for a Seismic Project or Seismic Data, is referred to as the “CEU Funded Capital” and the total amount advanced by Trigon during Phase One, whether for Land Acquisition Costs or for a Seismic Project or Seismic Data, is referred to as the “Trigon Funded Capital”. Preliminary Phase. 1) Although unlikely, the requirement of a Phase I and Phase II environmental site assessment can not be determined until after preliminary environmental reviews of the project sites have been completed. Therefore, the fee proposal will include this item as “To Be Determined” (TBD) and if the work is deemed as necessary, then a fee amendment will be negotiated with the city at that time.

Preliminary Phase. 1. Coordinate all topographic survey(s) and other investigations as may be required to prepare construction plans. Investigations and/or surveys shall locate existing utilities (private and public) affected by the PROJECT and shall locate and define such utilities sufficiently to enable proper plans to be made to relocate/adjust such utilities as necessary to fit the PROJECT.
2. Prepare a program of borings and other soil investigations that may be required for proper planning and design.
3. Plot information obtained from surveyor on proper plan in accordance with governing agency requirements.
4. Prepare preliminary layouts and sketches as required to develop design criteria.
5. Prepare an itemized preliminary construction cost estimate outlining all expected items of work and current unit prices for those items.
6. Provide written notice to all utility companies (private and public) regarding the PROJECT and request utility “as-built” information from them.
7. Attend meetings as necessary with OWNER and other entities.
8. Visit the PROJECT site to observe conditions, potential problem areas/conflicts, condition of topography, etc. On projects that are being financed partially or completely with state and/or federal funds, all necessary work associated with services such as, but not limited to topographic surveys, right-of-way maps, drainage maps, and geotechnical documentation, shall be performed in accordance with the most current standards dictated by the governing state/federal agency. This includes plan preparation requirements. ENGINEER shall be responsible for obtaining all necessary information from applicable state/federal agency regarding requirements for performance of work associated with any necessary supplementary services.

After the survey is completed, we will prepare a preliminary layout that will identify the existing site amenities and will identify proposed project features such as the proposed street improvements, sidewalks, drainage structure improvements, lighting, etc. Once the layout has been completed, we will meet with you to discuss and make any necessary adjustments. Preliminary Phase. After written authorization by the County Engineer to proceed with the Preliminary Phase, the Engineer shall:
1. Attend a preliminary conference with the County Engineer and regulatory agencies as required to establish the design parameters of the Project.
2. Consult with the County Engineer on the feasibility of viable alternative solutions for the stream crossing, preparing and furnishing sketches and data to support up to two alternatives.
3. Perform the necessary environmental studies and investigations to prepare a Preliminary Environmental Site Assessment and Wetland Delineation Report and prepare and submit a written report on same.
4. Submit to the County Engineer in three (3) copies a preliminary bridge layout for the selected alternative prepared in accordance with Texas Department of Transportation (TxDOT) guidelines and as directed by the County Engineer,
5. Prepare an opinion of probable construction cost of proposed construction.
