Premiums and Deductibles. Developer shall be solely responsible for payment of all insurance premium requirements hereunder, and the City shall not be obligated to pay any premiums. Developer shall be responsible for and pay any claims or losses to the extent of any deductible amounts and waives any claim it may ever have for the same against the City.

The Supplier shall promptly notify to insurers any matter arising from, or in relation to, the Services and/or this Agreement for which it may be entitled to claim under any of the Insurances. Where any Insurance is subject to an excess or deductible below which the indemnity from insurers is excluded, the Supplier shall be liable for such excess or deductible. The Supplier shall not be entitled to recover from the Authority any sum paid by way of excess or deductible under the Insurances whether under the terms of this Agreement or otherwise.
Premiums and Deductibles. All insurance premiums, excesses and deductibles payable in respect of the insurances referred to in clause 36.1(a)(i) shall at all times be the responsibility of the Contractor.

However, a co-owner shall pay such deductible if the cause of any damage to or destruction of any portion of the Project originated in or through an apartment or any component thereof without regard to whether the co-owner was negligent.
