Common use of Prescription Medication Benefits Disclaimer Clause in Contracts

Prescription Medication Benefits Disclaimer. Filling a prescription at a pharmacy is not a Claim for benefits and is not subject to the Claims and Appeals procedures under the Employee Retirement Income Security Act of 1974 (ERISA). However, any Prescription Medications that require Prior Authorization will be treated as a Claim for benefits subject to the Claims and Appeals Procedures, as outlined in this Contract.
