Pricing the Variation. (a) The Parties must negotiate in good faith to agree on the price for a Variation based on the prices listed upon the Order (and where no such prices are listed using reasonable market rate prices at the time of the Variation). If Owner and Xxxxx do not agree on the price for a Variation, Owner has the right to impose on Hirer a fair and reasonable price for that Variation.

Pricing the Variation. Unless the Superintendent and the Contractor agree upon the price for a variation, the variation directed or approved by the Superintendent under Clause 40.1 shall be valued under Clause 40.5. The Superintendent may direct the Contractor to provide a detailed quotation for the work of a variation supported by measurements or other evidence of cost.

  • Amendments, Changes and Modifications Except as to the termination rights of both Parties as indicated in the Facilities Lease, this Site Lease may not be amended, changed, modified, altered or terminated without the written agreement of both Parties hereto.
