Pricing to Customers. The range of daily rental, per foot or per well amounts to be charged by Distributor to a Customer for lease or rental of a Tool shall be determined by the size of the Tool, the conditions of the geographic market where the Tools are deployed, wear expectations and Customer acceptance. Distributor may change the rental charges to a Customer from time to time upon advance written notice to Seller. The Parties shall jointly collaborate to set lease and rental prices to all Customers and/or End Users based on each Party’s knowledge of the market, the Market Penetration Expectations and ongoing market conditions for the Tools. For the avoidance of doubt, all pricing to Customers for the Tools shall be acceptable to each Party.
Pricing to Customers. DHI shall set the pricing for sales to its customers of Instrument Systems supplied to DHI by Immunicon pursuant to the Distribution Agreement.
