Common use of Procedure Step 4 Clause in Contracts

Procedure Step 4. If the grievance is not resolved at Step 3, the Association may demand arbitration, by written notice to the Superintendent within twenty (20) days of receipt of the Step 3 response. Such demand shall be in writing, and it shall be delivered in person or by registered or certified mail to the Superintendent. If any question arises as to the arbitrability of the grievance, such question will first be ruled upon by the arbitrator selected to hear the dispute prior to the hearing on the merits of the grievance being conducted.
