Product Testing and Storage. All Products and applicable ingredients shall be subject to laboratory testing in compliance with State of California regulations on prices and terms as mutually agreed by Supplier and Indus (“Product Testing”) at Supplier’s expense and Supplier shall be responsible for the consequences of any contamination or product failing to meet product specifications in accordance to mutually agreed to product specifications. Supplier shall bear the costs of all such Product Testing and shall reimburse Indus for all such costs as incurred, provided that to the extent there shall be amounts due to Supplier under the Payment Settlement provisions below, such amounts due from Supplier for Product Testing may be set off against amounts then due to Supplier from Indus. To the extent that any Products fail Product Testing (“Defective Products”), Indus shall promptly notify Supplier in writing. On or before five (5) days from the delivery of such notice by Indus, Supplier shall instruct Indus in writing whether to return or destroy such Defective Products. All costs and expenses of the return or destruction and disposal of any Defective Products shall be paid in advance by Supplier or offset against any amounts owed by Indus to Supplier.

  • Drug Testing (A) The state and the PBA agree to drug testing of employees in accordance with section 112.0455, F.S., the Drug-Free Workplace Act.

The testing will be conducted in accordance with current Employer policy.

  • AIN Selective Carrier Routing for Operator Services, Directory Assistance and Repair Centers 4.3.1 BellSouth will provide AIN Selective Carrier Routing at the request of <<customer_name>>. AIN Selective Carrier Routing will provide <<customer_name>> with the capability of routing operator calls, 0+ and 0- and 0+ NPA (LNPA) 555-1212 directory assistance, 1+411 directory assistance and 611 repair center calls to pre-selected destinations.

  • Random Drug Testing All employees covered by this Agreement shall be subject to random drug testing in accordance with Appendix D.

  • Quality Management System Supplier hereby undertakes, warrants and confirms, and will ensue same for its subcontractors, to remain certified in accordance with ISO 9001 standard or equivalent. At any time during the term of this Agreement, the Supplier shall, if so instructed by ISR, provide evidence of such certifications.   • Treatment Program Testing The Employer may request or require an employee to undergo drug and alcohol testing if the employee has been referred by the employer for chemical dependency treatment or evaluation or is participating in a chemical dependency treatment program under an employee benefit plan, in which case the employee may be requested or required to undergo drug or alcohol testing without prior notice during the evaluation or treatment period and for a period of up to two years following completion of any prescribed chemical dependency treatment program.

  • Labelling and Packaging C17.1 On dispatch of any consignment of the Goods the Contractor shall send the Authority an advice note specifying the means of transport, the place and date of dispatch, the number of packages and their weight and volume. The Goods shall be packed and marked in a proper manner.
