PROPONENT. The Installations Division (AGI) is the proponent of the Oregon Military Department (OMD) State Rental Program Incentive Pay Policy.
PROPONENT acknowledges that the Confidential Information consists of confidential and proprietary information of OCC and agrees to hold the Confidential Information in strict confidence. Proponent agrees not to make use of the Confidential Information other than for the sole purpose of discussions, negotiations and contractual arrangements with OCC regarding the Subject Matter and not to release, disclose, communicate it or make it available to any person other than employees, agents and permitted contractors of Proponent who reasonably need to know the Confidential Information in connection with the RFP, and which employees, agents and permitted contractors are bound to protect the received Confidential Information from unauthorized use or disclosure under the terms of a written agreement with the Proponent. Proponent shall not reverse engineer, decompile or disassemble any Confidential Information or use the Confidential Information other than for the purposes set out herein. Proponent may disclose Confidential Information if required by any judicial or governmental request, requirement or order; provided that Proponent will take reasonable steps to give OCC sufficient prior notice in order to contest such request, requirement or order by notifying OCC of such request.
PROPONENT as directed by DTSC, shall publish, in a major local newspaper(s), a public notice announcing the availability of the RAW/RAP for public review and comment. The public comment period shall last a minimum of thirty (30) days.

PROPONENT. The Prospective Concessionaire will be the Proponent identified below, provided that, prior to the execution of the Agreement pursuant to paragraph 4 below the Proponent may create a subsidiary owned as described in section 6(i) hereof (the “Subsidiary”) to be the Concessionaire, in which event the Subsidiary shall carry out all of the obligations of the Concessionaire under the Agreement from and after such execution.

PROPONENT. (a) Reviews the proposed additional services requested, estimates the fees (i.e., OCWA costs to be estimated on a Time and Materials basis according Schedule D);
(b) Obtains quotes from subcontractors, suppliers, or vendors, and if necessary, adds those quotes to the estimate of OCWA’s time and materials costs, attaches those quotes to the service request;

(b) Invoices the Township for the Additional Service.
