Protection of PHI. VRC will use appropriate safeguards to prevent the use or disclosure of PHI other than as provided for by this Agreement, and shall implement administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity and availability of Electronic PHI that it creates, receives, maintains or transmits on behalf of the Practice.
Protection of PHI. In the event that Boston Scientific determines that returning or destroying the PHI is infeasible, Boston Scientific will notify Provider of the conditions that make return or destruction infeasible. In that event: (i) Boston Scientific will extend the protections of this BA Agreement to such PHI and limit further uses and disclosures of such PHI to those purposes that make the return or destruction infeasible, for so long as Boston Scientific maintains such PHI; and (ii) Provider will comply with its obligations under this BA Agreement with respect to any PHI retained by Boston Scientific after the termination or expiration of this BA Agreement. This section will survive any termination or expiration of this BA Agreement.
Protection of PHI. Business Associate shall protect against any reasonably anticipated threats or hazards to the confidentiality, security, or integrity of PHI and protect against any reasonably anticipated uses or disclosures of such information that are not permitted or required under 45 C.F.R. § 164, subpart E. Business Associate shall implement policies and procedures to prevent, detect, contain, and correct security violations.
Protection of PHI. In the event that HealthSnap determines that returning or destroying the PHI is infeasible or would not allow HealthSnap to continue its proper management and administration or to carry out its legal responsibilities, HealthSnap may retain such PHI. In that event: (i) HealthSnap will extend the protections of this BA Agreement to such PHI and limit further uses and disclosures of such PHI to those purposes that make the return or destruction infeasible, for so long as HealthSnap maintains such PHI; and (ii) Provider will comply with its obligations under this BA Agreement with respect to any PHI retained by HealthSnap after the termination or expiration of this BA Agreement. This section will survive any termination or expiration of this BA Agreement.
Protection of PHI. In connection with its receipt, maintenance or transmission of PHI on behalf of Customer, Xxxxxxxxxx.xxx shall cause SFDC to do the following:
(i) In accordance with 45 CFR § 164.502(e)(1), ensure that any Subcontractors that receive, maintain or transmit PHI on behalf of SFDC agree to restrictions and conditions no less restrictive than those that apply to SFDC in this Addendum with respect to such PHI;
(ii) Use appropriate administrative, technical and physical safeguards, and comply, where applicable, with the Security Rule with respect to any PHI that constitutes Electronic Protected Health Information, to prevent Use or Disclosure of PHI other than as provided for by this Addendum; and
(iii) To the extent SFDC carries out the Customer’s obligations under the Privacy Rule, if applicable, comply with the requirements of the Privacy Rule that apply to the Customer in the performance of those obligations; notwithstanding the foregoing, the Parties acknowledge that, under the Agreement and this Addendum, unless otherwise agreed upon by the Parties in writing, SFDC has no obligations to carry out any of Customer’s obligations under the Privacy Rule.
Protection of PHI. Business Associate agrees to implement adequate safeguards to prevent improper use or disclosure of PHI. Improper use or disclosure shall be considered use or disclosure that is not provided for in this Addendum.
Protection of PHI. In the event that Boston Scientific determines that returning or destroying the PHI is infeasible, Boston Scientific will notify Covered Entity of the conditions that make return or destruction infeasible. In that event: (i) Boston Scientific will extend the protections of this BA Agreement to such PHI and limit further uses and disclosures of such PHI to those purposes that make the return or destruction infeasible, for so long as Boston Scientific maintains such PHI; and
Protection of PHI. In connection with its receipt, maintenance or transmission of PHI on behalf of Customer, SFDC agrees to do the following:
(i) in accordance with 45 CFR § 164.502(e)(1), SFDC may disclose PHI to Subcontractors and such Subcontractors shall have the rights to Use and Disclose PHI pursuant the agreement between SFDC and each Subcontractor, provided that SFDC shall ensure that any Subcontractors that receive, maintain or transmit PHI on behalf of SFDC agree to restrictions and conditions no less restrictive than those that apply to SFDC in this Addendum with respect to such PHI;
(ii) use appropriate administrative, technical and physical safeguards, and comply, where applicable, with the Security Rule with respect to any PHI that constitutes Electronic Protected Health Information, to prevent Use or Disclosure of PHI other than as provided for by this Addendum; and
(iii) to the extent SFDC carries out the Customer’s obligations under the Privacy Rule, if applicable, comply with the requirements of the Privacy Rule that apply to the Customer in the performance of those obligations; notwithstanding the foregoing, the parties acknowledge that, under the Agreement and this Addendum, unless otherwise agreed upon by the parties in writing, SFDC has no obligations to carry out any of Customer’s obligations under the Privacy Rule.

(i) in accordance with 45 CFR § 164.502(e)(1), ensure that any Subcontractors that receive, maintain or transmit PHI on behalf of Xxxxxxxxxx.xxx agree to restrictions and conditions no less restrictive than those that apply to Xxxxxxxxxx.xxx in this Addendum with respect to such PHI;
(ii) use appropriate administrative, technical and physical safeguards, and comply, where applicable, with the Security Rule with respect to any PHI that constitutes Electronic Protected Health Information, to prevent Use or Disclosure of PHI other than as provided for by this Addendum; and
(iii) to the extent Xxxxxxxxxx.xxx is to carry out the Reseller’s obligations under the Privacy Rule, comply with the requirements of the Privacy Rule that apply to the Reseller in the performance of those C O N F I D E N T I A L Page 29 of 46 obligations; notwithstanding the foregoing, the Parties acknowledge that, under the Agreement and this Addendum, unless otherwise agreed upon by the Parties in writing, Xxxxxxxxxx.xxx has no obligations to carry out any of Reseller’s obligations under the Privacy Rule.
